Default fined for selling my car

hey guys just wanted to know if there are any loop holes for , i recieved a fine for parking my car in a car park with a for sale sign fine reads,PARK OR STAND ON A COUNCIL RD BEARING A FOR SALE SIGN INDICATING THE VEHICLE IS FOR SALE PENALTY $150.00 i mean how are you supposed to advertised a car for sale if you cant afford to pay for internet or paper

I do believe it is actually illegal. I remember reading a news article about some guy getting done for the same thing.

Hang on a sec...

There are too many questions / variables here... the fine mentions on a "council road"???

Also, if you were in a car park, what kind of car park? was it just a grass patch next to the main road where cars happen to park every now and again?

If the car park was a council car park, what does this car park service? could you have said you were actually using the car park to use these services???

Also, was the sign a huge board across your windscreen or leaning against the side of the car facing traffic, or a small paper stuck to the inside of your rear window??

I have an area close to me along a popular road, grassy, not really a car park, but has been used to 'advertise' cars for sale.

There are now council signs warning that no cars are to be parked there for sale...

its a main rd with a legit carpark beside the rd as it is near a school it did have a huge board on the windscreen there are no signs saying dont park there and sell your car

Yeah, the board is whats done it im assuming....

There are a few areas here where people park their cars that are for sale, one place would have up to 15 cars on one weekend, its just along the side of a main road here. Havn't heard of anyone being fined for doing it.

Agree with what people have said, if the car park is used for the school or a shop or something similar, just say you were in there using that.

It is illegal to have a for sale sign on your car without also displaying a RWC in Queensland I believe. That will probably be your problem.

Two different things here - Council and Qld Transport (Qld Police enforced):

1) You have been fined by the COUNCIL for selling on the "side of the road". It is obviously a council law - only $150. It must be a Gold Coast City Council thing.

2) You are lucky the cops didn't fine you - without a Safety Certificate it is $375.

From Qld Transport:

"What vehicles must have a safety certificate?

Vehicles include cars, motorbikes, caravans, trailers (0.75–3.50 tonne ATM {Aggregate Trailer Mass) and any other vehicles up to 4.5 tonnes GVM (Gross Vehicle Mass). "

"If you fail to display a safety certificate on the vehicle from the moment you offer it for sale you will receive an on-the-spot fine of A$375."

Having a "For Sale" sign on your car ANYWHERE is considered as being "offered for sale".

Hi 482bze,
Unfortunately Dan is correct in all the items he raised and added to that, it is a Gold Coast City by-law that you cannot display a "For Sale" sign on your car larger that an A4 size sheet of paper.

I know in NSW you can't just put up a for sale sign
and sell you car on the side of the road.
As this is illegal have been on the news before already.

If you can afford to put petrol in your car you should be able to afford to advertise your car. I'm sure you will be surprised at how little it would cost to advertise.
There are some mediums out there which allow you to pay only if you sell the vehicle.

yep tis illegal. that law's been out for about 15 years.

i remember my old man nearly got into a punch up with a guy because he gave him a ticket at nelson bay for advertising his car for sale ( just incase you haven't clicked yet, my old man was the council ranger )

its a sh!$y fine but if you don't pay it, they treat it like any other fine, debt agengies, loss of licence etc etc.

like suggested, just get one of those for sale sticker packs from supercrap.

hey mate why dont you try advertising in the Quokka? It's free and very popular and i have sold a few vehicles successfully in this magazine

Also seen heaps of people with tickets on their windscreens for the same offence over here in Perth

"Free to advertise anything you want" as the Ad says: www.quokka.com.au

Keep re-listing as many times as you want for free or pay about $5 for things like having your article in BOLD

it was put in place because the car yards complained long and loud about losing sales and apparently causing crashes where people pulled off and on main roads after stopping to check out cars for sale, if you have a unregistered car parked in same area you dont need to display rwc but then your car can be towed away by council as dumped you lose either way, trick is to find someone you know living on a main road who will let you park your car behind fence line for sale so its not classed as council land (nature strips) or roadways for main rds dept.

I got a question for somethig like this,
Say you lived on a main street and as MOSt people park their car on the nature strip..as your legally able to do?...
because everynight you park your car there(not onthe road but on the grassy part outside the front of your house), putting a 4sale sign on your car makes it different?!

My bro was done for parking his car on a main road advertising it for sale. He rang the cops and they told him that is is illegal to park your car ANYWHERE with a for sale sign on it, other than private property. Nature strips outside of homes is considered public so therefore I guess you could be fined for parking there too.

You are have a very good point though.
