How'd you find that out?

Would be very surprising that Mr. Plod would be having a beer on the job so blatantly. Would be a good story though.

If your story is true though, the photographer would want to take that straight to the media and/or Police Integrity Commision.

However I think the simple explanation is probably the right one, that it was confiscated and he was holding it so it wouldn't spill in the car.

If that was the case the would have tipped the beer out

confiscated or not, the driver is still sitting behind the wheel with an open bottle.
if that were any of us, what do you think would happen.

Yep, it is illegal to have open containers of alcohol inside a vehicle.

Thats in the US australia there is no laws relating to this. the driver however is not allowed to drink while driving. As this makes his blood alcohol level variable meaning the police cant get a consisant reading. (given the alcohol still in the mouth throat etc)

This is in fact the case in NSW. These laws are state not federal, what's ok in one state can vary quite markedly in other states.

Its not Illegal at all, nor is it illegal to drive and drink a beer, unless it is a By-Law where some council areas don't allow an open bottle of alcohol in certain areas.

Really. Cops in Geelong have been pulling over taxis when they spot passengers with alcohol bottles and fining the passengers. It was in the local paper. So it must be a law if they are doing it.

What is the reasoning behind this law?

Here you have people doing the right thing and getting a cab when they are drinking and they still get pinged. :

I remeber during schoolies, when alcohol was confiscated the police would pour it out on the spot and take the bottle with them when fining people. Maybe the PoPo were indulging in a couple cold ales while on the job?

it was taken here in W.A, it defently looks like a beer, theres another thread on it over at perthfalcons.com.au, classic photo but! ;)

just read on the other forum someone rekons it could be a softdrink

"Hate to say it, but that Schweppes soft drink in the glass bottle. Not Tooheys Extra Dry. Tooheys doesnt have the red symbol on the logo on the top of the bottle. Schwepes does...Also Tooheys has a very skinny long neck. schwepes has a more fatter angled neck....

Look.

http://www.schweppes.com.au/discover/ Except his drinking one one with a green logo. you can also see the silver/brass coloured cap on top on the bottle. Both on the site and in the photo

Here is Tooheys.
http://www.tooheysextradry.com.au/

Sorry to burst the bubble. But its soft drink...."

he may be wrong though because in W.A our tooheys bottles look different from the ones on the webpage, conspiracy!

Sure i have but i don't go around booking other people for doing the same thing.

Once again it's a case of one law for them and another for us.

Give someone power and it's a case of when, not if they start abusing said power.

I've seen cops on numerous occasions driving with one hand on the wheel and the other gripping a macca's cup. Speaking of macca's, i was in the carpark once and this commo was parked with it's drinks resting on the roof of their car. I did the right thing and beeped them to get their attention and pointed to the roof, trying to make them aware so they didn't spill it, and the bastards gave me the finger and sped off. I ended up going in their direction and sure enough they had pulled over with coke all down their nice paint work........karma

If that is alcohol, it wouldn't surprise me one bit!

Police work is very stressful and if having a cold one helps them get through their shift, then why not?...

Would it affect their judgement (especially at night)?...probably, but then they're just human beings doing their job.

It's not their fault society has deteriorated so badly and they have to deal with it day in, day out.

And then they have to enforce all the new laws & restrictions which only make the average motorist even more agitated. They didn't come up with these laws, they just follow orders, simple as that.

Not to mention the crappy wage they get and the constant danger they face, it's amazing they get through the day without a few beers! (I'm joking )

Probably a confiscated bottle too!

A girl i used to know got serious with a cop from down in sydney a while back, after a night on the sauce he was letting everyone know that confiscating alcohol was a perk of the job. They used to see who could collect the biggest haul in a single shift, tip away the open one and then make off with the rest of the carton. Depending on how far he may have stretched the story out, but he never has to buy alcohol.
