Default Car accident Tuesday 31st October (Lots of pictures, 56k go make a coffee)

Hi all
Myself and my partner Alex were involved in a car accident on Tuesday night at about 8:45 pm. We were driving citybound on Main North Road (SA), making a right hand turn on to Hogarth Rd. We entered the intersection on a green arrow, made it across two lanes of stopped traffic, when a lady disregarded the lights, came through the left lane on the other side of the road and straight into us at 80 km/h. She bounced off of my car and continued to take out a traffic light. The front of her car (EL Falcon XR8) struck the front left quarter panel of my car (EA Falcon GL wagon). We all escaped with minor bruising, but both cars are total write-offs.

Me and Alex both opened our doors, got out the car and walked away. I've got a massive bruise on my knee but the doctors said there is no permanent damage thankfully.

Anyway she is claiming that I ran a red light, but how would I make it across two lanes on Main North Road? I have one witness's details and he is backing up my story. She doesn't have insurance, but I do and I'm putting the claim in tomorrow. She's a P plater by the way.

Thank god for seatbelts and EA Falcons! At least I have a spare one!

Glad your OK. Hope they nail that P plater. If it's not bad enough that she could have killed you, now she is lying about what she did.

Thanks mate.
This is what infuriates me. It's not the fact that she ran a red light, accidents happen. I've caused an accident before, but I admitted that it was my mistake.
I'm really annoyed that some people won't take responsibility for their actions. That way, she might never learn, and next time lives could be lost.

If she hit you from the left, then it doesnt really matter what she is claiming
1st basic rule of the road is give way to your right.

The insurance co. asked me to include a hand drawn diagram showing what happened. They'll clearly see which side she hit me on so that'd be a big help.

I know of someone who claimed the other person ran a red, but they T-boned them on the left side. There were no witnesses to back up either claim, so he was at fault for not giving way.
Even with witnesses, ive even heard of some blame being attributed to the person hitting the car from the left, despite having a green light.

Hmm interesting.... I can't wait to hear from the insurance people. Might be getting another car out of this

My girlfriend was at a T-Intersection making a right hand turn, while a car was approaching with their indicator on, she proceeded to pull out and BANG that person decided to continue striaght.Witnesses everywhere and she was at fault..

So fortunately you do have right of way!

But even though you have lost your car, which is probably an absolute pain in the **** and you probably have heard this a thousand times but "as long as you guys are ok, that is all that counts!"
doesnt bring back the car though!... Karma works in mysterious ways!

Nasty hit. Glad nobody were seriously hurt. Goes to show how safe the EA is. I had a car accident in my EA over 4 years ago and I was surprised I got out with only a couple of scratches on my knee. I was at fault and I admitted it to the cops that attended. That girl sounds like an idiot. Hope she is found to be completely to blame. Good luck

Mate - you and your friend are a couple of very lucky people.

Main north road has its obvious shortcomings but what makes it worse is the people who take the most insane risks along there - and it seems there are lots of them.

Hopefully after some unpleasant words from your insurer (and a debt to pay off), she'll lift her game when she gets back on the road.

Amazing... people lose their licence every day for driving in a manner which increases the risk of an accident.. yet when they actually cause something... no action taken.

I also drive this road, usually every Monday and also on weekends. I have also seen the calibre of drivers along this road and just shake my head in disgust.
Best example I saw only a couple of weeks ago. Someone in a Camry must have done something to annoy this P plater in his fully sik VN Commodore. He then tail gates this poor person for ages, sverving and dodging lanes. Eventually, he pulls out and in front of the Camry, and then decides to slow them down and pretty much come to a stop. Now, for those of you that don't live in SA and don't know Main North Road, in some places it is a 3 lane carriage way in both directions. This tosser had decided to stop the Camry in the middle lane in reasonably busy traffic! I don't know how many other people he held up as he was behind me by this stage, but I just though what a d***head! :
It's people like that which make that road notorius and unsafe. I was disappointed that I couldn't get their number plate so I could report it to the police.

same bl00dy thing happened to my girlfriend while i was in the car.
she came to a set of lights and there were 2 cars in front of us, we had stopped at the red light and then a green arrow turning right came on, so we followed the 2 cars through the green arrow and a car had come straight through the red light coming the other way and plowed into our side, the a s s h o l e was beeping his horn at us too just before he hit. well he beleives he didnt run a red and he got away with it with my girlfriend having to pay $750 excess. the insurance company couldnt work it out and just put it down that my girlfriend didnt give way. what a crock!

bad luck anyway mate. thats why every time i go through a set of lights i damn well make sure i look everywhere first! especially when i have arrows i slow right down and if i cant see if theres cars coming due to other cars being in the way then i wont go. i dont care if theres cars behind me beeping. gotta make sure thats all because theres come idiots on the roads who cant drive for s h i t!!!

Is there a red light camera at that intersection?

It may also be good to know her driving history.

If you got her surname, driver licence number and card number you can look it up (at least here in NSW)

looking pretty pleased with the result there in the second pic :P or maybe pleased you both escaped with next to no injury! which is good to hear. i can picture the type of person who caused your accident, and it makes me angry just reading it. and why the **** would anyone drive an el xr8 without insurance ?? or any car for that matter. I used to work for a rental car company, people were always writing our cars off, the dealings with various insurance companies were very painful, and yes bizarre claims are made and sometimes believed. However in your case i doubt you'll have much of an issue. Good luck with it all.

p.s. and it was a 30th anniverysary falcon :(

EDIT: you should also make note of expenses incurred for checking out your leg injury, as you should be able to claim that too. That will come off her TAC insurance (provided her car was actually registered).

That's why insurance doesn't always pay.
For the one time you deserve some coverage, some other ***** lies about the details and gets away with it, despite it clearly being their fault.
If she's found to have lied, she should be arrested for misinformation, then made to work a red light district.
That'll teach her for lying.
