Hi all,
I had a company come out to re-gas my aircon today. The guy that did it was extremely rude. I paid cash (because he told me they dont take eftpos) and he left me with a receipt, not a tax invoice. The receipt has no number on it and he didnt even copy it for his records. It is quite clear that he is doing cash jobs and not declaring them to the tax man. Normally i wouldnt be to bothered about it but because he was so rude I rang up and asked for a tax invoice. I got told that i couldnt get a tax invoice because the company is not gst registered. This ended in an argument ending in him saying he was going to report me for releasing gas into the atmosphere, which he has no proof of. Is this dodgy? I was under the impression that every business that supplied goods or a service had to charge GST. I really want to report him to the ATO or somebody, im also tempted to name and shame but not sure how that could go down. I normally do research before i get people to do stuff like this because im very fussy about who i will let work on my car, i was rushing this time because i wanted to get it done before the end of financial year. What are peoples thoughts on this? Cheers in advance

they love this stuff.. talk to your consumer affairs rep and state ombudsman.. thats generally where I start things off..

He should be able to give you a plain invoice, not a tax invoice.
He says he is not GST registered, therefor he can't charge for GST. Was it a company, or a sole-trader? |

Turnover of $75000, or more, must register for GST.

If his business has a turnover of less than $75,000, then he does not have to be registered for GST.
This of course means he cant take up the Input Tax Credits on his business aquisitions. |

That regas is going to cost you alot more in 12-24months, he has used cheap *** hichill gas- basically lpg. The system is not designed to run on that gas. Its a touchy subject and i expect some people to argue with me but theres a reason that all A/C part that have warrenty are immediatly void of warrenty when log is used

Also your system has been opened to atmosphere meaning he SHOULD of replaced the reciever drier (accumulator) this guy seems really dodgy

Depends, how long did you have the ac pipes off while you did the engine change? Anymore than 24hours in a dry climate or 6-12hours in humid climate runs the risk of killing the a/c compressor. An a/c system does not like moisture, any moisture in the system damage the compressor really quick resulting in a siezed compressor and "black death"- a contamination off all ac compenents requiring extensive flushing and cleaning

I dunno if I'd want something that's "basically LPG" running through my aircon system, what if there's a leak somewhere, potential BOOM?

the aircon system was never fully disconnected, gas was accidently released but there was still some gas left in the system

I don't know the in's and out's of air con gas etc. But I remember when I was reading up on the format of a receipt for my own business that if it was below $1000 it didn't need to be as detailed as one above $1000???
This was 5 years ago now... things may have changed and my figures could be incorrect. Perhaps, because it is a small amount he did the bare minimum needed???

Many late model cars will suffer compressor damage by using hichill, many swear by it because it can be colder than R134a and they can do it without a licence and it's cheaper

Not sure what the issue is. Being rude is one thing and something you should avoid in business to avoid tarnishing your reputation . However I'm not sure that any crime has been committed here or why it's so important to the OP that he receives tax invoice from this guy. He has a receipt with the ABN number on it and if the guy who did the work is not required to be registered for GST he is not obliged to issue a tax invoice. Also there is no apparent fault with the workmanship is there apart from a dispute about the material used? I doubt ACA would be interested in this story.

Yeah I agree with GT0132. You have no evidence to suggest that he does indeed turn over $75k. The invoice with his ABN and the price charged should suffice.
If you don't like the guy, avoid him next time.
