Ive got a bit of a dilemma regarding a car accident in my car and was wondering what you would do?
Here's the story.... About 3 or 4 weeks ago, a couple friends, my brother and I were heading home after spending some time in Adelaide. On the way home (friend driving at the time), we were involved in an accident. There was a dead roo on the road and my friend claimed he had not seen it till last few seconds where he had tryed to avoid it (which he did) but sent us out of control into a wire barrier. Now heres my problem, do I ask my friend to pay for the insurance excess? The car has been written off and I dont have a car to get around in. No one was injuired thank god for that! I am unsure to as if I ask him? What do u guys think! Any thoughts, advice appericated!

If he was a true friend he would be offering as far as I am concerned. He was driving at the time so it is his f up so therefore his responsibility.

Yeah what xespac said. If he'd your real mate he'd be feeling guilty as hell and offering to payfor it etc etc. If he's not, then he's prob just a 'mate' as in a bloke you know but aren't that close.
If thats the case then ask him for the money, he doesn't care about you so don't worry about tip toeing around his feelings. The fact that he saw it at the last second is irrelevent, he crashed-he pays.

As driver he should be paying up the excess.... friends or no friend.

If he doesnt say anything, im going to bring it up and see what he says..
at minimun i would want half, i would be happy with that i guess

Assuming that you knew what his driving capabilities were you still let him drive. You knew the risks, it's your problem. Seeing as you're asking for advice I'm guessing that you have a high excess?

IMO the driver contributes the vehicle, the passengers pay for the fuel and this I think should happen for the excess. Although if it was me, I'd suck it up and pay the excess and chuck him a tray of grog as an apology |

I'm assuming that all the people saying that the driver should pay the excess would be quite happy to do the same.
How about if it was only driving your mates car around the block and you get hit by an uninsured driver. Would you be prepared to front up the $1000+ excess. If the owner of the car wants to reduce his premiums by having a higher excess then I'm sorry, but it's the owners problem. Why should a friend be penalised because the owner wants to save money. Unless the friend happens to say "your excess is only 1k! no problem, I can handle that if I bump into anything"

I would definitely be asking for the excess, it was his fault, you shouldn't have to fork out just because it's your car. Don't let him treat you like a door mat, mate or not he stuffed up and now owes you a considerable sum of money. If he refuses to pay then his true colours will be revealed and it's tribunal time.
