Yesterday on my way to work, at arounf 230pm i was in the right lane and was passed by a cop bike travelling in the opposite direction.
A few minutes later i see him hooning up behind me. So i thought, ok one of these surrounding cars has done something. But then hes pulling ME over. "Ok, random licence check or whatever". BUT, he then grabs his ticket book and proceeds to the car. Im like, WTF is he doing. I was doing 5Ks under, and stuck behind the car. The first thing he says is "were you making a call or receiving one". I said, what do you mean, i dont even have a phone on me. So, he asks me to get out of the car, and makes me pat my pockets, and lift my shirt with about 10 or so people walking past. Im there, with everyone thinking ive got drugs or something. SO he then asks me where the phone is, and says the usual threats about lying to police and whatever. I then say to him, search the car. Things were pretty heated by this point. He searched EVERY possible corner of the car (My old XF), until he came up tp me and asked me to open the boot. I said, "mate, seriously, think about what you are saying. How the Hell am i supposed to get the phone in the boot while im driving". He paused a little and then said, "i must have made a mistake". I then asked him what his name was again, and glared at his badge. Walked to the car and slammed all 4 doors and SPED off.. I really didnt give a crap at that point... Now what would have happened if i had a phone in the car?? I would be in the ИИИИ. Maybe i had my hand on my ear or whatever, but what a dick... Sorry for the long post :P

All I can say is I've tried talking on the phone while driving once and haven't since. It is a distraction as far as I'm concerned and can see why it is enforced. But when people so much as put their hand to scratch their ear and get pulled over, well that's going too far. I vaguely recall such an incident where this happened and the person essentially got fined for scratching his head.

yeah ive had that i was cruising up a long straight road with my head leaning on my hand, cop went passed and whipped it round pretty fast accusing me on talking on phone i got my call register out showed him no calls for bout 2 hours then i showed him my messages nothing there. he then looked in my car for another phone, found nothing then he had a very good look over my car (lucky i brought 4x new tyres 3 days earlier haha.

Sorry the cop was wrong this time but I just hate ****ers using their mobiles even more than those with their front fog lights on.

I was just waiting for him to pin me for something, but seriously, he was too red faced and just walzed on over to his bike, and slowly put his helmet on... Lucky i wasnt in the other car... Front mount intercooler, too low, exhaust too loud, and the rest under the bonnet... The trusty old XF had no faults, luckily for me anyway..

The Problem is every second car you see on the roads at the moment has at least somone either on the phone and or writing a text message.

Even if he had found your phone you can aquire records from your telco detailling all calls & texts in and out for a period either side of the time and date on the TON.
Show this to the prosecutor of the offending plod's station (preferably via the OC) and it will all be fixed and the aforementioned plod might even get a kick up the bum. Remember all TON issuing is taped and that tape can cause them just as much grief..... |

I have noticed that her in Sydney the major culprits for mobile use while driving appear to be Females of Asian appearance and dring 4WD's. One of my MAJOR hates.
Boosted, are you youngish looking? The reason I ask is most times that heppens is to younger looking drivers? Maybe police think that ALL young people are heroin delaers, marijuana freaks and mobile phone users? Stereotypes :( |

I hate when people talk on their mobiles while driving. But once I saw a guy in his BMW 5 series chatting on a phone and the coppers were right next to him on a red light. Nothing was done by the cops.

I used a hands free on a mobile once while i was driving, but it makes no difference at all, because it's the action of concentrating on a conversation that takes your alertness away, not holding the handset to your head. Just goes to show you the inadequacies of our legal system. All mobile communication should be banned from a moving car. Fine, have a car kit, but pull over when you receive a call, or if you can't, wait til you can then call them back. I HATE these heroes that pretend to be leaning on their hand while 'hiding' a mobile, and the (seemingly always) young chicks sending sms's while swerving all over the place in their lancers.
Said it before, i'll say it again, there is a TIME and PLACE for everything. :

Unfortunately mobile phone use whilst driving does cause accidents. It was good of the copper to pull you over. But to go to that extent is rediculous. I watch people drive at 15 klms under os swapping lanes without signal dayly and as you pass them you see they are on the phone....

I'd like to see the legislation that allows 'stop and search' in relation to this offence and if it applies to a person, persons, or just the vehicle - or both, AND if it includes handbags & bags when carried outside the vehicle. Bit by bit your inhereted rights go. . . |

a while ago i was a passenger in a car and we pulled up at the traffic lights next to a police car, and much to my amazement i looked over to see the police man was talking on his mobile. i immediately went to my pockets for my phone to take a picture to ИИИИ him off whilst haveing quite a good chuckle, only to realise i didnt have my phone on me. so i grabbed my mates which was sitting there, but it didnt have a camera, but i pretended it did , to see mr policemans response, and he put his phone down straight away and looked very flustered.
we were actually expecting to be pulled over and hassled after, but he just roared off, haha. |

Good Ads on TV at the moment here in SA (Elswhere?) about this subject. The talking and SMS'ing on phones that is, not cops with 10 more fines to issue before their shift ends!

Well i didn't know you had conversations with all those devices you just mentioned, but if you do, that is a different story, and something you may wish to consult someone about. As i said, it is the concentration required for having a telephone conversation which is the distraction of someone using a mobile phone while driving, i've never found the operation of a high beam toggle all that involving, nor vaguely listening to a radio station, and so on.
I have strong opinions, i don't expect everyone to agree with me, especially on a huge forum, but if you're going to make a point, make it legitimate.
