My guess is most likely yes. You’d have a hard time convincing a cop it wasn’t yours if it’s on your property.

Cheers, Danny

The question is if you knew it was there, and if it could be proven.

stash the weed - bury the bag in the garden perhaps and if she doesn't pay, withhold the weed and car - she won't go without both

The offences we would be looking at are possesion DOD, depending on qty and other items found, cultivate and traffick DOD. In regard to possession of a drug of dependence we would need to prove your knowledge of the item and prove it was in your sole possession or prove many in possession. For example I did a warrant on a house and found 199 cannabis seedlings. Four people lived in the house. Only one admitted to knowledge of the plants and had hidden them from police just prior to our arrival. She admitted this. One she had knowledge and two she hid them, showed a guilty mind. I can only charge her.

Does anyone else have access to your car, could have anyone else put the items there etc, they would be the issues looked at.

You do not have to prove anything,It's the police who have to prove you guilty, that's how our system works, knowledge of a crime itself is not illegal

I believe the correct term is "accessory after the fact".

CRIMES ACT 1914

Part IA - General

SECTION 6 Accessory after the fact

6 Any person who receives or assists another person, who is, to his knowledge, guilty of any offence against a law of the Commonwealth, in order to enable him to escape punishment or to dispose of the proceeds of the offence shall be guilty of an offence.

bury the weed with something that will break it down (lime?) and just leave the car where it is. If she says "WTF!" about the weed then say "I told you to clear out the car"

you have no duty to help the police in an investigation, but dont lie if asked that could get you into trouble, saying nothing is not a crime, being asked and concealing it is

Wipe the bag down and leave it in the car, it's got nothing to do with you if she's a junkie. It all comes down to proof and if they can't prove it's yours your right.

I'd be getting rid of the car ASAP. The fact shes asked you to hold it for a while could mean shes keeping the car away from the long arm of the law for one reason or another.....

I would certainly keep myself out of the ИИИИ, drive the car back and tell her to check more carefully next time.....

For People that i dont know well , i give them the car they give me money. and never any probs .
When i seen this stuff i told her to get rid of it ..
I was talking to her today about it and she said that she cleaned it up best she could as her vacume cleaner dont have a hose so she pulled the plants and "Gave it a quick Brush"

Maybe i should stop stressing about it and just Plod on like normale.

So you are saying it is all on the floor not actually in a car? So whats your problem, how on earth are you supposed to know what it is? Are you a horticulturist? Different if it was in a bag or something but not just on the floor.

Is dope really that illegal over there? Geeeee.

If that was here and the cops found it, they'd sit down and smoke half of it with you.

Honestly, don't you think you're being a little bit paranoide? Have the cops ever looked inside cars you've worked on before?
