I bought a car last friday from sydney. Negotiated a price, and told the guy i needed a few days to arrange freight. Was due to be picked up tomorrow arvo, and i just spoke with the guy to confirm.
On friday when we spoke, he was happy as larry, i offered a deposit via eft, and he said that as long as i assured him we had a done deal he was happy to just sort out all of the money tonight in 1 lump sum. I assured him that it was a done deal, that my word is my promise, and that i had the funds, and would transfer tonight when i called to confirm a pick up time. WELL!!! : :jab: !!!!!!!!! This is where the fun starts, he just called me, me thinking to confirm times and with account details. Instead he tells me that there is someone else coming to look at the car, (which is sold to me) and that he has straigh out offered 10% more than the price we agreed on, sight unseen. So basically i can match that, or he'll sell it to him! So i said basically, yeah we'll you've got me over the barrel dont ya! I have planned on getting the can, already bought other bits for it, and we had a verbal handshake deal on the car. He basically replied that he needs money so i match it or it goes! I had originally planned to pick the car up on saturday myself, but struck a good deal on freight so was going to let someone else do it. I said if i had have picked it up on saturday there would not even be a car there now, and that basically his word was worth $h!t and that i was basically being made to bid on something that i had as far as i knew bought. So i said as i am apalled that his word meant nothing, i have basically no option but to match what he's asking, and that usually on a matter of principle i would tell him to jam it, but i cant see me getting the same deal anywhere else so am still better off. I told him i will match his offer on the 1 condition that the buck stops there! If he calls the other guy and tells him that i matched it and he offers more, stiff. Makes me so angry that you have to treat everyone as a liar these days because peoples standards can be bought so cheaply. Yes, its my fault as i did not push harder for him to allow me to make a deposit and be given a reciept, but makes me so so so angry! Been stooged on a house the same way! I treat people as honest and in good faith, but guess there are less people around like that now! : : |

Tell him to **** off, I reckon he's probably just pulling your leg so you'll give him more money, he'll come running back when it doesn't sell.
But there's always the chance that he may be telling the truth and if that's the case then he's just a rat!

Yeah that sucks, have heard of similar stories before, its like blackmail eh?
I've had a problem when selling a car on eBay where they won the bid, flew down from QLD, then proceeded to offer $2k less, which I refused, then getting a negative feedback from them. Can't win these days buying or selling.

sounds like your getting taken for a ride.
tell him to sell it to the other guy and see what happens. get your mate to ring up monday and ask if the car is still for sale as he is interested. if he says the car is still there then you know he was only trying to get more $$$ out of you. if its not there then bad luck basically. i wouldnt be held over a barrel like this. a deal is a deal and if i feel im being taken for a ride then ill pull out. |

You realise he has just probably played you and played you big time..
Hate to say this, but I would almost bet money on the fact that there was no other buyer, there was not a better price... It is up to you if you pay more than the agreed price but I personally would ring him back and say, sorry, found a car better condition, better price and closer to me.. so you can ring the other dude back and sell it to him... Or tell him, no you aren't going to be ripped off.. cos that is exactly what he is doing... It isn't fair or right, but seems to be the way so many do things now.. Good luck with it and it shows that unless you know the person then don't trust their word..

Yeah i realise that there may be no other buyer, but i am not in the position to take the risk and lose it. Kind of counting on it, and dont think i'll find another 1 for close to what i got it for otherwise i would certainly tell him where to jam it. Thinking about offering him the original bucks when i get there, and if that doesnt work, knocking him on the head with the exhaust pipe!

I had similar hassles selling my future mother in law's VL Calais. Had a buyer from 3-4hrs away come to look. Mother and Son combo, car was to be for the Son. They liked the car and arranged an RACV test but didn't leave a deposit. We said we'd hold the car seeing they travelled a long way and spend $120 odd on the RACV test. Seemed to be a formality unless the test revealed major problems.
Later on another person and his Son rocked up, liked the car and offered cash on the nose. Dilemma!!! Did the right thing by the out-of-towners and explained the situation to these people. The Father and Son were not happy but understood. Didn't crack the sads. Seemed like very nice people. I got the guys number anyway just in case. We got the RWC first thing next morning (car breezed through) RACV report done next day and out-of-towners not happy. Picking it for little bits and niggly things you normally find on an 18yo car. Report generally good, no major faults. Scumbags were trying to drive down the price. I got aggro and told them I turned away a cash buyer to do the right thing by them because they had gone to trouble and expense to inspect the car. Told them I'm going to ring back the second group and offer them the car, they called my bluff. Rang the second group and told them I'd been screwed around by the out-of-towners and that they now have the option on the car. Told them the RWC is done and the car is ready to roll. Knocked a little bit off the price because I'd screwed them around. They came over, handed over the cash and the young man drove away in his 1st car with a huge grin. The Father bought it for him. The Son kissed his Father on the cheek, gave him a hug (very European) and thanked him very much. It was one of those warm and fuzzy moments. Felt like ringing back the out-of-towners to give them a huge earfull but my better half talked me out of it. Never heard from them again. You try to do the right thing and you get screwed. I was very lucky not to lose the sale altogether!! Sorry about the long post!!

Schmidty, let it slide.
My cousin went through a very similar deal on a Mustang last Easter. In th end he bought it, because it was a good deal & it was the Mustang he wanted. EF XR6's are a dime a dozen, pranged or otherwise. As you said, you've bought heaps of cars over the years, so you should be able to source the bits easy enough. should of told him you'll be seeking legal advise for his tactics though im sure he wouldnt care,im doubting he had a better offer and if this was ebay then you should of reported him for this.
if it was privare then your fubar'd no money swapped hands no deal or sale as such. good luck n hopefully the BS stops. |

Yeah it was a private sale. And actually 1 off here. Thats as much as i'll say on that.
But anyway, just irks me that people can be bought so cheaply. Personally, i've done money before as to not break an agreement. I sold a car, and was offered 1k more for it the day after i shook hands on it with someone else. I said to the guy as apealing as is offer was, i entered into an agreement with someone else by handshake, and i had to keep my word. If i wanted to buy a car at auction, i'd go to the auctions! If i wanted to sell a car at auction, i'd sell it on ebay! Looks like i'm off to sydney in the morning. 1800km round trip. Big day! |

When I first joined Ford Forums a member agreed to buy my stereo, so i added to all my for sale adds that it had been sold. Then after agreeing to buy it he asked all these questions about it (questions you should of asked before agreeing to buy it) THEN he tried to bargain my price down AFTER agreeing to buy it. THEN he said he found the exact same model but cheaper and asked if I could match it. I told Him no as he has agreed to buy it already at the price it was for sale. ANYWAY then he said as I couldnt match the price so he apparently bought the cheaper one. DIRTY DOG
I also got ripped of by another "former" forum member who didn't disclose all the defects on some rims I bought. But the Mods Banner her - that was awesome. Anyway now when I sell stuff I will only note it is sold after i receive the money or a deposit - Lesson Learnt And when I buy something I will check it out thoroughly before I buy it. I was under the impression Ford Forum members look after each other and yes that is mostly the case but there are still some snakes around that ruin it for everyone.....

I was pi$$ed off, then he takes me and shows me the tyres and 2 were about 75%, and the other remaining 3 of the set of 4 were in the minimum legal tread were markers! So basically were good for about a week before being unroadworthy. By then i was livid! Just wasted 3 hours and $40 bucks in petrol to again be shafted! |

Money isnt everything IMHO.
When I sold my SS I had other guys lined up and pushed back as I had a young lad from country SA going through the process, which is a pretty remote process when you live a couple of hours away. YES I could likely have got more, but in the end I've sold it to a good fella (and his dad came down too) and Im happier than having a little extra cash....

I know the car you’re talking about Schmitdy, I’d let it slide if I were you.
Going back on you word is as bad as lagging. I sold my XR8 to a fellow forum member and you wouldn’t believe it. A couple of days after agreeing to the sale, a call from out of the blue asking if the ute was for sale. This person replied to an old ad that that had a price significantly higher than what I was selling it for. I just told the person that it had been sold as I’d given my word to this bloke an I knew he was genuine. The person gave me his number and told me to ring him, just in case the deal fell through. I could have sold it to this other bloke for more money, however, I wouldn’t be able to live with myself, as I’ve been brought up in the belief that once you’ve given your word, that’s it. The problem is with people that you don’t know. I’ve been let down plenty of times by people I don’t know. I’d be checking the Fowles website, you never know what you’ll be able to pick up in the salvage area, and more importantly, tell this **** to jam it. Not as bad but been done by lowlifes like this too. Twice selling cars had people agree to buy them as long as I got a RWC check done so theyd know what they were up for. Said as long as your serious not a problem. Needless to say got stiffed both times so never again. Next time deposit up of $100, if not see ya later.

Schmidty, that is very dodgy. And often knowing that you are being shafted doesnt make dealing with it any easier. Of course you knew what he was most likely doing, but it still doesnt change the risk of calling his bluff and losing what is still a good deal. And that is what that bloke was betting on too.
Whether or not there is another bloke prepared to pay more, is not that relevant anyway, he has shafted you either way. There is such a thing as a verbal contract that can be legally binding in certain situations too, I must go look that up. Just because something is not in writing doesnt necessarily mean it isnt binding. I hope it all works out for you mate! I know you are good person, you have helped us out a few times now and we are really grateful. I just hope this all works out and that you get the car ok. Jac

My grandfather copped the a dodgy from a pub owner in adelaide when he was trying to buy it, kept getting phone calls saying that they had been offered more money, so he matched it each time, eventually he said, nah, not interested anymore, sell it to the other bidder, lo and behold, 2 years later it was still on the market from the same owners, greedy greedy people. tell him to shove it

It went against my principles, but i really couldnt be bothered with the whole process of looking around and going trough all of the same crap again.
So, left at 3:30am this morning for a solo run from winchelsea to bowral. 1800km return trip. Just walked in the door @11:05pm. 250L of diesel and an average of about 13.8L per 100m which is pretty impressive considering i was pulling 2.3tonnes of car and trailer @ 110 - 120kph! What a ***** of a drive, uphills, downhills, uphills, down hills! NSW roads are crap! Glad i didnt tow it with the XR! I'm trying to find an upside to being shafted! ha. Here's what all the fuss was over The joys of buying privately! |

When it comes down to it, a verbal agreement can be classed as a binding contract and be legally ackowledged as such. I know, Dad fought this out with a mechanic who did a dodgy on a Landcruiser he bought.
Mechanic ended up having to pay for a full 'Genuine' Toyota rebuild at the most expensive disel fitter's in Queensland as well as court costs. Like they say but. Sometimes it's worth it. Sometimes it not. Lumpt

when i sold my VK Charger...it was to a bloke in Brissy.
I had it advertised for $9000 with RWC Since a roady wouldnt count in qld. and i was in a rush, we agreed on 8000 I later on got calls from people who previously saw the val and said ill give you 9500 considering i allready got a deposit from the queenslander via bank deposit i was a good citizen (as all MOPARIANS are) and sold it to him.....although "shafting" him was a option that came to mind....im still thinking what i should have done ??? did i do the right thing? haha |
