You're right. From what I understand by Indiana law he could use private email to conduct official business but it is subject to public record.

Legalities aside it is what was used against Clinton quite a lot in the election campaign. Same **** as far as I'm concerned.

There is no comparison between Hillary and Pence, at this stage anyway. But I will agree with you if say in 10 years time there have been millions of dollars spent investigating the 30 emails that were hacked by a Phishing scam and the case could still be under investigation.
