You're right. From what I understand by Indiana law he could use private email to conduct official business but it is subject to public record.

There is no comparison between Hillary and Pence, at this stage anyway. But I will agree with you if say in 10 years time there have been millions of dollars spent investigating the 30 emails that were hacked by a Phishing scam and the case could still be under investigation.
