Default Car Just Written Off By Police... :(

Some sad news for Ford Lovers...

My beloved 92 EB Series 2 Fairmont was written off last Tuesday by an undercover policeman... To cut a long story short, I was driving round a bend on a 2 lane road that was cut down to 1 lane due to roadworks. I was driving behind a Subaru Forrester and then once the roadworks had finished I pulled into the left hand lane and was driving alongside the Suby. The police then decided to turn left from the right hand lane and obviously didn't see me. The Suby collected me just in front of my door and then we skidded next to each other for about 30 metres going over a gutter or two... The whole right hand side of the car is caved along with the front and rear bars, the bonnet, the bootlid, my ED XR6 grille, headlights, 2 ED XR8 rims, 2 tyres, numerous steering components and who knows what else...

The police have admitted fault so I'm waiting to get my payout. Just curious to know what I should be expecting in terms of a payout as everyone seems to have very differing opinions.

The car was silver, on LPG, 230,000kms, ED XR6 Grille and headlights, ED XR8 rims, good rubber, engine was ok, tranny was ok, interior was very clean. Let me know what you think people.

the forrester was pretty bad, worse than mine. he took out a stop sign which dented his whole front end and cracked the windscreen as well i think. the old girl stood tough haha

You're probably only going to get market value. I doubt they'll take into consideration any mods you've done. I'd be expecting between $2-3k.

If they are claiming responsibility you can ask for anything that is reasonable, dont accept their first offer.
An agreed value through your insurance company means nothing to them as their insurance is paying out, someone who you dont have an agreement with.

Make sure you get a rental car for the period you are off the road.

hows this, my EF 2 fairmont got repaired at work as a stolen recoverd when my mate had it in august last year... with CGU market value was at $10,200 lowerd with FTR's exhaust and yeah.. 260,000kms behind it... and I have the papers to prove it aswell lol.

It just depends on how clean and looked after the car is, and well the fairmont was a absoutle pig when it was stolen in august.

FYI Although I am sure if you got yourself a probono laywer to take on the case , you may in fact get awarded a few thousand dollars, of which about 90% will go to pay the lawyer and as far as statistics go on a CTP claim, it is not uncommon for a straightfoward claim to take a minimum of 2-3 years to process, hardly worth the tima and effort if it is a bogus claim, only people that win are the lawyers.

If you have comprehensive insurance claim through your own insurer, if you don't, thier assessor will in due course assess your vehicle for what it is worth. Contrary to what has been said here, it is the assessors job to make a fair and reasonable offer on your vehicle and in every case I have ever seen with people getting an indpenant valuation the assessor is either spot on or over what the valuer put the vehicle at.
Modifcations will usually lessen the value and not increase it as most modifications have removed an OEM part to replace with a cheaper aftermarket part.
Allow me to explain that.
For example;
A sports exhaust, may be fitted and cost you in the range of $500-$1000
Now if you where to have replaced it using the OEM (genuine parts) the cost would have been between $1500-$3000 so effectivily you have lessened the value of the car.

at least they admitted fault, my dad was driving along flinders st Melbourne in the early 70's when off duty cop came flying out of some lane near the old AGE building and knocked the split window Kombi clean over on to its side , where as the driver (in Uniform) jumped out and begged my dad not to report accident so my silly trusting old man agreed as long as copper fixed car, needless to say dad had a bad neck for months and cop was never seen again while we kids travelled around in a very ugly battered Kombi van for the next 4 years , the beginning of why i neither like or trust police and lots of things happened over last 38 years have only made me trust cops less.nowadays they wont even charge people with some crimes because they say judges wont sentence person so why bother, its that attitude that makes them just revenue raisers in my eyes.
mate take them to the cleaners if your hurt in any way as they would do it to you in a heartbeat,

well im glad to say that i wasn't hurt at all, just a bit shaken up as most people usually are after an accident. im just glad there was more damage to his car than mine. a little quote comes to mind...

a bit of news guys, i ended up receiving 3G for the car, not bad considering i picked up an EL mont with 150k's on the clock of a family member for 2,500... however, some bad news, it turns out i now have a ruptured disc in my spine which my physio thinks was caused due to the accident and since it didn't start to hurt until i had signed the waiver releasing the cops from any lawsuit or claims, i can't do squat about it. so im out $300 for doctors and physios, and i can't work for 6 weeks.... what an absolute drainer, so now im broke and bored, but at least i got a new car, where everything works! haha

Fairly standard procedure when you pay someone out for writing off their car. The waiver/release that my lawyer knocked up when I paid out on the car I hit basically just protected me against them later deciding the agreed amount wasn't enough. However i don't recall it mentioning injury.

If the Subaru was unmarked and the members are plain clothes there is a good chance they were dogs and following someone. Sorry to hear bout your loss of your pride and joy. Good to hear they are not stuffing you around.

well after having a lengthy discussion with dad this morning we decided it was probably not worth the hassle even though i am out of pocket a substantial amount. considering the injury slowly got worse and worse it took me so long to go and get it checked out and therefore dad thinks it will be too hard to prove and as previously mentioned the TAC often take a long time to even hear your case.

The only real good thing that came out of this whole situation apart from the fact i got a newer car, is that I have learnt a valuable lesson, even if it was the hard way. Always see a doctor after an accident even if you feel fine! thanks for the help and suggestions guys.
