Transferring a car from father to son - stamp duty

I was just checking out the vicroads website, and I seen that in some cases, stamp duty doesn't apply when transferring a vehicle from one name to another.
My car is currently under my old mans name, and I wish to transfer it to mine at the end of the year. Has anyone else in Victoria transferred a car to immediate family members and had to pay stamp duty?

Just transferred one from my missus name into mine and cost $36.00 transfer fee, but I had to show them our original marriage certificate. If i couldn't show it, stamp duty was payable. Unsure if it applies father to son.

in WA you are allowed to 'gift' the car over but not sure on the market value.

Stamp duty is a scam. The car already had stamp duty paid when new, the govt is double dipping ARGH!!!

You should be able to sign it over to yourself without incurring a stamp duty fee.

IIRC, in victoria car transfers between husband and wife do not attract stamp duty or require a RWC. I think this also applies to an inheritence. All other transfers require a RWC and stamp duty.

in qld if there is no money changes hands then no stamp duty to pay.

: mine did. : i had to transfer the ute from my business name into mine when i sold the shop. had to show them proof that i owned the business.

i think if you are transfering from another person you would need to have a signed declaration or something.

Lol, do you know how many cars get purchased for "cheap" prices, its common to tell the queensland transport a low figure to avoid paying too much stamp duty....

about 2yrs ago the guy just signed the transfer papers without putting a figure in so I put a figure in that I was happy with

In Vic I thought that the RTA could charge you stamp duty on the market price of the car (glasses, red book not sure which one) if they were a bit suspicious on the buy price of a car.

The RTA people must have seen a thousand times something like this I reckon. "No sir, I honestly did pay $300 for the Ferrari"

Hands up who has put a lower price on the transfer form so the stamp duty would be a bit lower.

In Queensland it is based on 'market value', not exchanged value, so that is not exactly correct.

1. if ownership is changing due to a divorce settlement or

2.changing from business to individual (and vice versa) if individual also owns the business.

Gifts (i.e father to son etc) deemed to be at market value

Are you sure? Because I just sold my EL today and it had a field where you wrote the 'dutiable value' down and then there's a percentage you use to calculate how much you pay... I think 3.5% for the Falcon but I don't know how much the buyer paid in stamp duty cause I wasn't with him.

Sorry mate, that is incorrect. As Hunter said, there is a box on the transfer papers where you write down the value of the car/motorbike whatever.

It shows on the form if the amount paid is less than the dutible value, you are supposed to show it. Most people will ask for you to show a lesser value for stamps however!

They've got us covered in NSW, if sale price is less than market value then stamp duty is applied based on market value...

I tried to do this last year (father to son). From memory it was something like 10% of market value plus a 30-odd dollar transfer fee.
Does anyone know what it would cost, to change my rego from my current personalised plates, back to the old plates that were originally on the car that I still have in my possession?
