The law says that you may protect your property or another person with force that is not excessive or pre-meditated. If the only thing you can grab on the bench in a 10" shifter or a butchers clever so be it as long as you can show that you were in fear and had no other option. And a warning is as simple as " off". If you have a firearm next to the bed on the other hand that would be classed as pre-meditated.

I would assume there would be some form of leeway for detaining a person without authority?

Citizens arrest. Perfectly legal to stop someone commiting or continuing a crime.

Detaining somone will get you in serious trouble.

However like i said above.

There is no problem if the body is never found.

Detaining someone (Citizens Arrest) when used legally ie. when you find someone commiting an offence, will not get you in any trouble whatsoever. It is the same law that security guards fall under to make an arrest.

By what means are you allowed to detain them? Do you have to lock them in a room or can you use cable ties on their wrists and have them eat the floor?

It all depends on the situation, remember that security guards use handcuffs and come under the same law so cable ties and floor eating (my favourite) are ok.

At least with a maglite, its primary function is a torch. You were using it to investigate what the noise was. And when you realised that it was a burglar and he rushed at you, you used the maglite to hit him out of panic and self defence.

With a shifter, all you can say is... yes I used a shifter to make sure that he would have his skull cracked.

The law was changed in SA a few years back.

You can now use whatever force you deem necessary to protect your family from an intruder.

A case in example was when a guy stabbed two home invaders with a samurai sword and killed one of them. The second was very lucky to survive due to massive blood loss.

He was charged and taken to court but subsequently had the charges dropped.

The law was reviewed shortly after this incident.

Oh believe me, if I saw someone in my house, their skull would be mush. The largest size Maglite is not a light item. So when I swing it at their head while they try to take my , they will be dropped. Then, the cable ties come out and they are made to eat my pair of dirty smelly socks which just happen to be at their nose. :P
