IMO a very good read on how some of the scenarios of SOPA could affect those of us not in the US. Also on how the legislation could be used for anti-competitive purposes (in a worst case scenario) and how sites that allow comments/forums could be affected by it.

For the record, I don't dl music. I do dl TV, but follow it up by buying the iTunes/DVD copy once available (not a justification, merely clarifying). And I think that yes, piracy does need to be better policed. But this is an archaic and overreaching solution to the problem.

This SOPA legislation has little to do with piracy, and more to do with keeping quiet ideas, information and truths those in power would rather you didn't know about in much the same way they police the mainstream media.

As nearly all of the piracy content isn't even in a public location on the internet, it makes you wonder how this legislation is going to stop that and therefore it's obvious that piracy is not what this is about.

This is a freedom of speech thing and the natural progression after the NDAA bill that was passed at the start of the year.

This is a BIG Deal in the USA.........it is HUGE.

Working for a USA owned company - I can tell you that things like PIPA ( Intellectual property Piracy ) is a massive concern......There aretraining programs at work detailing responsibilities and repercussions on these sorts of things. Disciplinary action etc.... In fact - failure to complete the training course has become grounds for PIP ( Performance Improvement Plans and possible dismissal for persistent neglect on completion )

It's the fault of the discovery channel........too many details on those docos that allowed all those foreign NON US govts to just sit and watch them and then build their own tanks / warplanes / internet networks / Top secret Submarines and millions of other sundry societel dependant techno gadgets.....

Basically - it's a way for the US Govt to fill their coffers again after having them emptied by countless war campaigns over the last 20 years..........cynical.....yes ! Easy money on litigation......yes......

The technical resources section on this website "may" be an example where it "may" need to be licensed and permission granted for such literature to appear on this site. Especially if they have been cut and pasted from FORD literature.

The biggest impact from these sorts of laws really only affects the likes of legitimate "public face" companies and sites where they need to be open and honest about their sources and links......hence opening themselves to licensing agreements and spiralling costs.

Ironically - the "hackers" and pirate downloaders will always find a way around the IP and SOPA laws and continue to "breach" the system regardless.

This will be real interesting to watch as the Bills are heavily backed by some powerful lobby groups - so it is also very politically inclined and provides some distraction to the more pressing domestic issues that the US senate and govt alike faces.....

Let's take news creation as an example.

Sit on the content producers' side of the fence for a minute.

I was a journalist for years, so I have a very different take on this whole thing.

I have seen my industry battered by online. Magazines shut. Neswpapers collapsing. Redundancies... the kind of thing that, ironically, makes the news everyday when it happens to steel mills etc.

I can sympathise with the Newscorps and Fairfaxes of the world... it's a weird thing to be able to say, but when you look at it closely it's pretty clear.

If you say news should be free, have a think about where real news comes from. I'm not talking verbatim press releases, I mean interviews, fact checking, deep research, foreign correspondents in war zones... and sometimes following hundreds of leads to dig into a story.

Real news / information comes from people paid to sit on a story and investigate. Without them we would have nothing but press releases from industry groups with vested interests.

These people need to be paid. Journalism is pretty bad pay, but still the $ to pay them is drying up fast.

Newspapers ran on a revenue structure where the actual sale of the papers itself was run at a loss and it was advertising that paid the bills. Printing, selling, distributing and creating the news in papers is a non profit organisation when you take ads away.

Move it online... and you get a fraction of the revenue of a traditional paper - advertising online is just not creating that kind of revenue.

So... "stuff it I can get everything you need online!" Not true, not if you want organisations to keep the bas&&rds honest.

Research, build contacts... once a story is found, interviews are done, story is written, researched, fact checked, sub edited, and then weighed up legally (if need be) - only then does REAL news hit the public. Only then do bloggers and aggregation sites get news content for their readers... and they get the ad revenue?

It's vital that all forms of restriction on the internet are fought long and hard.

Here in Oz the government keeps crowing about a "filter" with the best of intentions to stop kiddie fiddlers, but most people realise that once you have a "filter" of some kind in place, it's easy for future governments to add whatever sites make them uncomfortable to the secret list of sites that we aren't allowed to access...this can be political or other oposing viewpoints that they don't want us to see in a Big Brother fashion.

File swapping? As the song said: "Hey Mr Record Man the jokes on you, stop running your label like it was 1992".
If I can't find a CD of some old cassette tape I have from 20 or 30 years ago, i go online to something like Bitlord and download it...why should I just shrug and say "oh well", and forget about getting it, or pay exhorbatant prices for one ordered from some music retailer here?

Reading the news today says that Megaupload has been shutdown and people arrested by the FBI. Not too much later Anonymous took down US DoJ site and Universal studios.

Agreed about the filter being ridiculous.

Disagree with that jpg. What a crock!

Does anyone honestly believe it's the people at the top of the food chain that lose out with illegal downloads, news aggregation etc?

The people who pay the price for reduction in revenue is the worker. In newspapers, it's the sub editors, the designers, the type setters, the mail room kids! These are the people who have been getting shafted and losing their jobs. These are the people who can't ask for a pay rise.

You're talking about an industry that is suffering from a change in delivery, not from copywrite problems. People will consume what is free if it's acceptable. They will pay if it is worthwhile.

Yes they will. But the point is, the industry is not going to be able to pay for its journalists to be embedded in war zones, or to sit on a political story for a year digging to get to the bottom of it.

And yes, I am talking about an industry suffering from copyright protections.

There are websites making money by aggregating this news and there are bloggers making money reporting the reporting... but the source of the news is struggling to survive. Shouldn't the majority of the revenue earned from a news piece go to the people who create the news? So they can keep doing it?

News wires (Reuters, AAP etc) are subscription services for papers etc - you use the content in your paper, you pay for the right to do so. Bloggers, aggregation sites etc are NOT PAYING for the news sourced, created and paid for by news organisations, so therefore it is a copyright issue.

The comercial news is doing this now. One channel grabs video from another, obliterates the logo and puts it up. Plenty of examples of this happening.

I've also seen commercial news leech stories from places like reddit and paste it up. They are just as bad as everyone. Apart from the ABC the standard of journalism in Australia is pretty poor.

A lot of footage from war zones is coming from people with videophones these days. Look at Egypt and the riots. This wasn't reporters getting the footage it was people on the street capturing the video.

As for the bloggers, blogging. Well that isn't an internet thing. Journalists often do opinion pieces on news that other journalists have broken.
