Default Avoiding probation

Hi all,

Unfortunate for me - i've gone and got a speeding fine for (111 in 100 zone) from an unmarked maloo last friday. Std low range 1 point and 130ish dollars..

Even more unfortunate for me - it was my final point after loosing 3 (of 4 total) for overtaking over double white lines :( as I am on my P's. Now providing all went well, I would move onto my opens home and free on the 3rd of July with full points and no restrictions - buuut due to this point being due more than 28 days away (about 35 days away) I stand to go onto my opens on the 3rd of July with a zero grog limit and and late night restrictions - either that or according to probation rules I can give up my license for 3 months..

What i'm getting at is, I have heard that if say I lost all my points less than 28days before I have to pay the fine, then I could just go in and pay it after I was onto my opens, and not go onto 'good bahaviour' because I would have full points. So does anyone know if this is true? and if so, would it work the same if I went on a payment plan with my final payment being in more than 2 months when I would have ticked over to my open license?

You will get lots of "advice" here, but what you need to do is go and see a solicitor.

I'm not going to court or anything? it will just be a simple yes/no to 3 months suspension/good behaviour period for 1 year.

I think at this stage advice will suffice - for a little while yet

no even if you go onto ur full licence they will just take it off you when it comes up anyway so save yourself the money and sort it out first

Pretty sure you can't have any outstanding fines before going for your license.

I don't know how it works in qld but I'm fairly sure a mate of mine was in a similar sitch recently and just waited it out (within in time limit outlined on the fine) till he was on his full license and then lost the point.

So you are on your P's and already croosed double lines and done 11k's over.
Not minor offences by any means.

So what makes you think you can go a year without breaking the law again?

You dont loose anything until you get to 5 points. So you can get 4 but get 1 more your gone so dont do anything wrong for the next month

In NSW they go off the points you had at the time of offense. My brother got done 2 weeks before moving to his greens and even though he paid the fine after getting his greens he still lost his licence for 3 months.

I think i've read somewhere on the QT website that it's 4..

Anyway - as expected there's been mixed responses, I plan on going onto the transport department tomorrow to ask.

Same here in Vic.
They take from the date of the offence (once proven, either by you paying the fine or being found guilty in court).
Doesn't matter when it's paid, if the offence occured within the dates of your probation, they'll add the points then, if you've gone over in that time, you're gone.

The one peice of info I can offer is that you WONT get onto a payment plan for your fine with a $130 fine. The payment plan is for $200 minimum in QLD.

Personally if it was me, Id pay the fine after you get your opens and see if you get lucky and just see what they do from there.
Id expect that losing your license would be a permanent mark on your driving history as would the other form of punishment you mentioned above, so Id pay the fine after your on your opens and just sit back and see if they pick it up or just let it be. At least there wouldnt be any mark on your record if they miss it. It is a government department after all.. Worth the punt in my eyes.
