Default Too good to be true?

So i am working away up the mines, and always trawling for a bargain old ford on Ebay, etc, they are all out of reach price wise the early x-series as most know, so i'm drawing a bow at xd-f's now.
So anyway, sunday night i spot this listing;

"Wow" I thought, what a bargain. Even if it's a rust bucket i could turn a handsome profit wrecking it. Gearbox alone is worth the asking price!

So i contacted Rob and struck up the deal, he wanted to move to thailand or somewhere and retire, $8000 was what he wanted and i said hey sure, i'll send a deposit , dependant on an inspection by a friend who is local.

Friend inspects and he tells me to BUY IT! It's ridgy didge and apparently immaculate, running well with a hot cam, prime LTD interior, 9 carat gold plated striker wheels, and a nascar block full of goodies allegedly!

So i get the thumbs up to put down the deposit over netbank, and $500 is recieved no worries on Monday night.

The rest of the week passes and i'm at work thinking daily about what i'm going to do with my new toy, selected personalised plates on PPQ, when is the next powercruise on to rip a skid.

Then today happens.

I hit him up to measure the OD of the trumpets so i can order some unifilter socks because most of them have deteriorated from lack of use.

Then I get a message at lunch time saying that he can't go through with the deal because it is in the ex wifes name and she has just had it towed away!?!?
I try ringing him but he won't answer at all, just text saying he's at the bank returning my deposit, and that women are !@#$ed rha rah rah.

I keep tryin to ring and ring, then get a call from the ex wife!?!?
She reiterates that the car is in her name, is not being sold because it is for their son and worth FAR more than what i was paying! Well no **** lady but fffffuuuuu......

So now the car is gone, i suspect there is a chance someone else turned up with more money and bought it. I would have payed more for it if he asked.

So if anyone knows this car or sees it around (gold coast), i'd like to know about it, so i can ask Rob for a please explain.

The worst part about this day.

It's my birthday today.

While it may suck, if it is seen getting around, he owes you no further explanation that what has been given.
Regardless of whose car it is, the car isnt yours.

Sucks, but if the car was in someone elses name, and you went through and actually gave him the whole eight grand, then when the Plod turned up to repossess the "stolen" car which you now have (which undoubtedly she would report it as), you'd be out your money completely and he'd be in a world of trouble...as if he isn't already...

You can't legally sell something that's in someone elses name...even if it's in joint names you need both parties to sign the paperwork.

I'd have been suspicious at the "spent $45,000" and selling it for only $8000...way too big a gap, way too good to be...well, you know the rest...

follow the "cautious buyer's treatus" (half of everything good, double everything that's bad) you might be a lot closer to the truth.

sorry you missed out on the car, yzfr, better luck with the next one. if the couple are going through a divorce, you probably dodged a bullet by not getting involved.

If you'd struck the deal via ebay, you would have been bound by a contractual agreement.

Not sure what he would have given you, as the car wasnt his lol, but thats for him to figure out

Yes well it appears that after i pushed the seller some more tonight, that the car has been sold to a higher bidder. For $17000! So he reckons.
So much for the ex wife story.

Do i have a legal standpoint here. I don't expect so.

I still don't know if it was the 'friend' that i asked to inspect the car that arranged the purchase with a 4th party. Seller denied it was him.

I have noted a post on another forum where it has been stated by my 'friend' publicly that he bought THE car, pics included, the day he inspected it!

My head is so full of !@#$ right now!

My Advice. Move on with your life. I know your upset, but end of the day, you got the cash back.

From a legal point, you do not have the right to claim anything as you did not own teh car at any point.

Well no deposit back instead i get a 2am call from the seller whos panicking about dudding me and hes sayin he and some mates will get the car back and the original deal will be back on??!? I couldn't believe what i was hearing.

Really dont give a hoot about the car anymore, but ive taken some action and now ill sit back and wait for the phone to ring and see which wsy it goes.

Mixed up affair this one.
