today i was driving down the highway and i was getting a few people giving me the old flash of the lights trick but that didnt bother me to much as i was in the work ute and its fairly guttless and is harder to go the speed limit then actually speed in it. Any how I just kept driving keeping a eye open to see if it would be a police officer with a gun or a mobile speed camera. I come around a curve in the highway coming into a small town and i spotted it. It was about 10meters of the road in the scrub half covered by long grass and low hanging branches of a tree, but to top it off it had a big yellowish greenish towl covering half of it so you couldn't see the police decals down the side of it till you were at the bonnet and it was to late. Now i thought that they had to be on show with there sign out so you can see it (wich they never do!) i was thinking about turning around and taking a pic of it with my fone to post up but i wasnt sure if that would be legal and i didn't really have the time. What is it like in other areas? they seem to be getting cheeky up here!

Nothing illegal about you obtaining evidence that you may later use in your defence, well not in this case anyway, it is a public road and your Qld law states that they (radar cops) must make mtorists aware of cameras in the area. All you are doing is showing that correct procedure was not followed and you will actually in effect be helping all motorists booked on that day by affording them a reasonable argument also.
This is the reason they changed the laws here in Vic, I still remember one in particular where they had a mobile camera set up in what was actually signed as a delivery van. They thought that they wouldn't need to because most people don't take note of delivery vans and by the time they got them might forget. I think that someone actually spotted the camera and the story was in the local paper in the following weeks telling motorists that they had a legitimate argument to have the fine and the charge dropped, which of course they all were.

So long as the law in your particular State is such that some kind of indication must be given to drivers of a speed camera in the area then if this isn't being adhered to you have grounds for which to argue the fine.
But check the law carefully as there may well be some exclusions.

Where can I go to check all these laws? People keep telling others to make sure they know all the laws, blah blah... But are they up on the internet or what?

xr8man, this wasn't on the old cap highway last night was it?
cos i was done there by a cop with a hand held, no fluro vest and it was almost dusk, you couldn't see any car or anything, and it was just after it tured from a 70 zone to a 60. I'm not even sure if she got my speed in the 70 zone or 60. Very ****ed off. |

yeah they are there daily with thier flash for cash mate.
i travel between gladstone/rocky and gladstone/bundy. worst cops i have EVER seen are in rocky though. if i never have to drive through there again it will be too soon. |
