Funny story - I put an old standard lamp and shade out on my nature strip two weeks ago. One week ago I went down to a local "antiques" place and found my standard lamp for sale at $345.00. Someone had rubbed it down with sandpaper, stained the wood a shade darker and put it up for sale. Someone's making a good profit margin.
Do I care? Not really or I wouldn't have chucked it out in the first place. Shows how quickly small business can function - within 7 days - gee that was quicker than the council collectors! Just funny - what are the chances? |

In my local government area they couldnt care less about people taking stuff from kerbside collections - in fact, during junk week, the junk collectors are like a non-stop procession.
Council WILL bust you however if you put your junk out on the verge outside the prescribed collection periods and/or you block the footpath or someone's driveway.

It's illegal (whilst todays news artical could be mythical in it's self)
The naturestip is the proprty of the council/shire and when you leaving unwanted items out there is becomes their property. The reason why can not remove from the item is simply due to 'public Liability', should you cut yourself on an unwanted piece of metal or burn your house down from a faulty electriac appliance, the council is liable, so it is illegal. This doesn't stop those trucks going around stealing the old lawn mowers, and any thing metal.

Why would you say that when the police superintendent says its not???
The property is owned by the person who placed it on the nature strip, Superintendent Forti said. "It doesn’t legally belong to the council." Do you have any case law to contradict him?

So anything left on the naturestrip is legally the councils?
So if I have to much stuff to fit in my garbage I just just throw it down on the ground and it becomes the councils problem? |

Its been said a few times now... if its on the nature strip IE "abandoned" then it belongs to no one. It doesnt belong to the council.

sometimes its worth going thru crap found a working lawn mower also found a nisflik or something vacuam looks quite newish that was thrown out took it home plugged it in and it wanted to suck but seemed to be blocked....took off the vacuam pipe and it started sucking fine found a beet bottle cap jammed in the pipe after removing it it was like new....seems we are in throw away world!n

A mate once scored a brand new auto washing machine from the verge - it had a loose active connection in the input-terminal strip - easy fixed.
Dunno why it wasn't a warranty job. |

I dont know about other areas, but in my neck of the woods anything left out on the side walk is still the property of the home owner and remains the property of the home owner until it is on the council truck, so if i dump an old vacum cleaner out there and somebody takes it they are taking it from me, but if someone trips on it the council is liable because they failed to keep pedestrian walkways clear, we no longer have a hard rubbish pickup due to all the crazy legal crap that goes along with it

If you are dumping on the council footpath because there is a waste collection happening, then you are abondoning the item, so its not yours anymore, you dont want it. A person taking the item from the footpath is not stealing.
Its abandoned... it doesnt belong to the council, nor does it belong to you as your dumping it. Its no longer in your possession.

It doesn't need to end up on a nature strip, certainly not on a "side walk" (is that the same as a footpath???)

its funny i play agame with the local scrappys i put a stuffed fridge out the front of my house the same day as the pickup truck was coming round and timed how long before it vanished ,,,,i got inside turned the kettle on and before it had boiled ....it had gone ...yea i know sometimes small things amuse...but yea scrappys here make a killing over the council pickup dates and good luck to them a couple extra bucks in there pockets instead of the councils which i might add only seem to be out there to make peoples lifes harder,,,

The reason the council didn't push for the old guy to be charged as that would set a precedent that the council is liable for anything (including rubbish) on the nature strip.
In this time of 'environment awareness' they should be encouraging this sort of reuse, rather than expecting the council to take ownership of it for recycling. Recycle is only for stuff at the END of it's useful life. The slogan is Reduce, Reuse, Recycle

Semi related.
When I was kid on holidays where my nan grew up in Swan Hill, my grandpa took me and my little brother fishing on the Murray. As we were driving along the road, he sees a bit of dump along the side of the road and pulls up to rummage through the rubbish pile. I was thinking what the hell is he up to. He comes back with a bird cage and some string he found. Never said much though. It was one of those things where as an 8 yr old (thereabouts) you just shake your head and dont think about it much more, but theres still the "what the hell" hanging over it. So we get to the river and he grabs the birdcage ties the string to it. He grabs a piece of soap from his Kombie and wedges it in the cage and drops it in the river and ties the string to a tree. He takes us for a walk along the river talking to us, pointing out things like grandpas do. After 1/2 hour or so we go back to the cage, he pulls it out. Its got a heap of shrimp in there, ahahahaha the bait. "What the" changed to "ah the crafty old bugger". One mans trash, is truly another mans treasure. |

The accused, TREVOR FLOOD, was a very good motocross racer in the past. His father had Flood Motorcycles in Box Hill, sold Bultacos, montessa's etc.
