Default Rego Transfer

Good afternoon all, This question relates to NSW rego and the fee's involved with transfer of ownership. I know in the past you have to pay a percentage to transfer the vehicle but what happens when the vehicle didnt cost you anything? My father-in-law is getting on and doesnt need his car any more (VR lancer sedan - in great knick! - its about 4yr old) and he's giving it to his daughter (my better half). Will the RTA let us change it over without paying a fee or will they go off market value?
If they go off market value, should I just say it sold for $1000 and say the gearbox has issues (or something like that?)

According to the RTA's site ............
Stamp duty is based on the market value of the vehicle or the price you paid, whichever is greater.

I know in Victoria - if it looks like you've under-declared the value of the vehicle, then they will send you a bill after you've registered the car - and what they believe the market value is at the time.

This happened to a good friend who bought an innocent little Mazda 3 from someone who sold it cheap (was going overseas - like they say) and she paid $14,000 at the time when they were going for about $17-$18k. Vicroads believed that this was too cheap, sent a letter stating that the purchase price is not correct, and demanded the difference in the stamp duty.

Ended up getting a stat dec signed stating that it was infact the purchase price, and even got the point of showing bank statements where the bank cheque was raised (for the same $14k amount).

Vicroads accepted it, but I'm sure there would be cases where they don't.

I was staggered - it wasn't like they declared they paid $4000 for a car that should be worth more. Though I'm sure a few of us have been guilty of writing a different figure on the registration papers than what we really paid for a car.

Hmmmm.... Just when you think you've caught a break, the government steps in and says "hang on a second champ, nothing is free!!!!!"
I'll put down 5k on the papers and see what happens, I think it's insured for 15K (so that would be close to market value?)
If they say anything I'll tell em it's got hail damage?

I bought a registered Festiva cheap ($500) that had a rooted engine, many dents and a bald tyres. I made sure the seller made a detailed receipt stating all this as justification for the low price. Back then, the market value would have been around the 5k mark.

Didn't have a problem with it..., I was also ready with pictures on my phone in case they wanted more proof.

I would not be telling them why it is cheap over the counter as that is what everyone else would do when put on the spot. Make up a detailed receipt, with all the personal info needed of your father in law and state that there are several problems with the car that require several thousand dollars to repair. Put his phone number on it and make sure he knows exactly what the receipt says. Get him to sign it so it all looks ridgy didge

Wouldn't say hail damage as that can be seen. Perhaps abused engine / gearbox that needs a rebuild etc.

Should save you a few hundred dollars in fees.

If the rego is on concession (pensioner etc) you will also have to pay the difference between concession and non concession rego as well at the time of transfer.

How about you just not do anything fraudulent (and Illegal), just pay the required fees and be thankful for the 15k gift your wife just got.

I did the same thing for my XD had the receipt to say incomplete car and while I was doing work on it I took a picture of the car with the guards and front suspension removed.
Still had to have the Manager of the RTA have a look but he looked at the pics and the receipt and said yep it's only worth $500

I just transferred rego on a '$100' car. no problem as it is 20 years old they didnt even blink

Did the transfer today, put down 5k as the sale price. All good. Didn't say a word.

What really sucks is that our blood sucking, useless, oxygen thieving government can hit a car owner up for transfer costs as many times as they like.
If a car gets sold 4 times in a year, then the bastards get 4 lots of stamp duty, all for just having to print out a new label and change 30 seconds worth of details in a computer.
All criminals and you won't hear a peep from either the government or the opposition because it is a major money spinner for them with virtually no output required.
Just build an RTA office and the money starts flowing in.

Try buying realestate on a regular basis in NSW if you think swapping car ownership is costly....

I could have bought a new car with what I paid in taxes / duties alone last time I bought!
