Default Licence help (VIC)

Just after some advice on a sticky situation I'm in.
So my licence was suspended for speeding, for one month, 33kms over. Safe to say, I learnt my lesson.
It is no longer suspended as of tonight (18th July) at midnight, and vicroads currently has my licence as I was asked to take it to them.

They said they will send it out, however, being the weekend, it won't get sent out until Monday earliest.

I have to drive to work tomorrow and Monday, but what are the risks involved of driving without a licence on me (no longer suspended, but no longer in my possession)
In 23 years old, Victoria.

Help would be appreciated.

You are supposed to produce your licence on demand. If you have a letter telling you that your suspension ends on 18th and VicRoads will mail the licence back to you, I'd keep that in the car so you can show the police if needed - it may or may not do the same job as producing your licence.

Thank you, I do have the original letter from Vicroads saying it will end on the 18th at midnight, so I'll keep that in my possession.
Normally I would not drive, just to play it safe, but for work commitments I have to drive.

If you are still a P Plater in Victoria then yes, you need to produce your licence if asked and will be fined if you don't. However, if you have a full licence this is not the case.

Yes, full licence for over a year now. I doubt I will get pulled over as I drive safe and follow the limits, but just after advice in case I do.

If you are a learner permit holder, probationary licence holder, under the age of 26 years or have a heavy vehicle licence, you must carry your licence at all times when driving or penalties will apply.

What are the risks? You get caught driving without it and are penalised.

Penalty depends on your license conditions. Generally,

Person aged less than 26 years failing to have licence in his or her possession while driving or in charge of motor vehicle
Penalty Offence Code: 2608
Fine: $74
No demerits

Probationary driver failing to have licence in his or her possession while driving or in charge of a motor vehicle
Penalty Offence Code: 2109
Fine: $148
No demerits

Those are the penalties as far as I can tell... unless for some reason there have been further conditions placed on your license because you've been suspended.

Hmm no good, where did you find this information? I tried looking on vicroads but couldn't find much.
Thanks for your help, will have to ale a tough decision in the morning. Yes, the fine is not a major one, but still a risk I'm not really willing to take. Thanks.

If I was in your situation I'd risk it.

If you do happen to get pulled over.... "Oh no! I left home in such a rush I've left my wallet, money, license etc at home, Yes sir, I'll bring it to the station tomorow"

Clearly I have learnt from my mistakes, what I did was the wrong thing and I admit that. Time to move on.
Unfortunately I cannot really wait, it's either find a lift to work at 4am, or drive.

How far is the drive? I think the worst thing is if you're working tomorrow its still friday night for a lot of people and the police CAN be out in force, if its a short trip I wouldn't stress nor if a booze bus stops you, I just wouldn't bother lying if you get caught they have everything at their disposal in the car regarding your fines and who you are just explain you got it back last night vic roads said they'd mail it you thought you would be okay to drive to work. But keep the piece of paper from vicroads with you and any other evidence.

Pray its not TMU..

If you are that worried, why don't you do whatever you have done for the last 4 weeks to get to work (while your licence was suspended)?

No it's not - I've been pulled over twice with no licence and both times Police said "that's okay so long as you're older than 26". When they look up my name on their data base in the car this obviously checks out, so no issue. VicPol if you're wondering.

I am correct, Police have the ability to be lenient if they choose (as seen in the comment in my previous post), but the law requires ALL drivers must carry their licence, it is stated on 2108 of the old mates link.

Go to Law Today, go to R for road law and find the LAW that states this bit about 26, I really want to see it and which part of the law this 26 year old thing comes from, I am talking Victorian law here.

Go and find me the law that states '26', then come back and prove me wrong, I don't want any hearsay, I want to see the law
