Post Spelling mistakes in parking fine

Hey all,

I haven't been on here in a while! I'm not even using the email address for my previous name anymore

Anyway, I've search and read all the threads on parking fines and speeding fines, but I'm curious to know if anyone has gotten out of a ticket because they have mispelt the location and street name on the fine!

It sucked because the signs weren't really obvious and its not like I was intentionally breaking the rules but I am looking for a way out.

Basically, the suburb is mispelt three times! And they spelt Vehicle --- Vehiclle..

Surely this would be grounds for an invalid ticket?

Anyone had experience?

Cheers.

I dont know if it matters about what state you are in and what judge you take it in front of, but yes I have heard of others getting their fines basically torn up because of stupid spelling mistakes.
I for one just wish the cop would have at least made one error on my latest fine, but sadly no such luck.....

Good luck and just try. Can't hurt to try at least anyway.

Cheers

You can state that your vehicle was never in the location on the fine (incorrect spelling) and the it was in another loaction at that time (use correct spelling) therefore you can not be fined for being there.

Hmm I don't think you would get off just for a spelling mistake.

You said the signs were hard to see and that you didn't know. Go down there with a digital camera take photos of the signs and write a letter explaining (using very apologetic language). Forward it to the IFB and the council (most take email). I got a phone call from the council a few days later apologising for fining me and they tore up the ticket.

EDIT - Note that mine was actually legitimate though, the ranger was in the wrong, not sure of your circimstances but it is just food for thought. (End disclaimer)

I actually did take digital photos because the signing was ridiculous in the car park. Basically there was three islands, one side had a fence and the signs were down low (I didn't see any of those cos cars were parked in front of them! : ) and on the outer island, the signs were on gigantic poles above eye sight height (from a car). On the middle island, where I parked, there was a single sign right down on end of the row, next to a bush.. and it was tiny!

So I'm feeling a bit jipped. If I had a visible sign, I had no problems parking properly.

I'm thinking now I'll write a nice letter, then if that fails, ask if the ticket is invalid.

Pity is, I think you can only appeal in writing once.

Good idea to say you weren't there BUT alot of the councils or the local police who do the parking fines actually use a digital camera to take photos of your car and the signage with a time and date stamp on them

Thats interesting, i didn't know that. If thats the case, it should only help me show the signs are not in adequate positions.

Tough choice on letter topic

I'm going to court in March '06, on this day 1 year ago, i got my second parking ticket in as many days.

the thing is i moved the car.

i got out of the first on and thought they were all cleared up, but i got a letter in the mail and have to go back to court to fight the second ticket.

i also got a parking ticket that showed the wrong time. it showed i parked in the parking lot at 11:53 PM when it should of said 11:53 AM. I wrote off to the infringement processing brearu of NSW and they said the ticket was issued justly, which ment i had to pay the fine.

if an office incorrectly spells the street name, you could agrue that your car was not in that location specified. and you have evidance which suggest your vehicle was in different location.

fingers crossed for ya

Spelling and grammatical errors can be amended by the issuing officer in court if it goes that far. If you write a letter and point them out they can cancel that ticket and re-issue a new one with the correct spelling.

This from the Australian Road rules and applies to signs for Parking
(8) In this rule:

clearly visible means:

(a) for a traffic signal—clearly visible during the day and night in normal weather conditions; or

(b) for another traffic control device or a traffic-related item— ****clearly visible during the day in normal weather conditions.******

normal weather conditions means weather conditions that are not hazardous weather conditions causing reduced visibility.

There is aslo a height min set out the rules as well for signage
