Don't count on the police officer knowing everything about human rights and the constitution, as someone said before they are just people doing a job. Many a defect has been issued and then removed by vehicle inspectors because there was no justification for it. The officer got it wrong. Because of this in NSW there is an undertaking by the RMS to assure the car enthusiast communtiy that the new legislation coming in is being taught to the traffic police to minimise mistakes. We are hoping that it is effective.

The priveliges you mention are in every facet of our lives in this country. Its called freedom and we should be able to go about our daily errands and jobs without harrassment from the authorities

Of course if you are doing something obviously wrong then we already have enough laws to cover this.

Bigdamo says that about 90% of this forum are probably driving illegally modified cars. Its his assessment but lets assume he's close. This means that 90% want more freedom than we have atm not less!

Perhaps instead of wasting everyone's time by pulling them over for a random alcohol/drug test and checking persons details for warrants, vehicles for basic roadworthy they could put all those police in speed camera vans, feel free to drive through them as fast as you like so you won't be late

So what?
Sounds like they're going to just go back to what they used to always do. You'd get pulled over, breathalised, asked for your licence and registration as well, and the copper would usually do a walk-around of your car...shining the torch on tyres if it was dark...and have a squiz at the rego label.

No big deal...and if my car had been stolen, I'd prefer a little bit of attention given to the cars they were pulling up. Last time I got done for a random breath test, he just got me to blow in the bag and off I went...no check of my licence or rego.

I tend to agree with the first half of your post, but times have changed.
Unlicensed drivers or people knowingly driving stolen cars, I would guess they would not stop at RBT's, they would hope the chasing police give up after a 1 minute or 1 kilometre

Usually when we are in an RBT lineup, they do a quick look around the car. Rego label attached and valid, Tyres not bald, lights working. Seems the norm.

It's probably a good thing that they will be putting more effort into these roadside stops. There are many cars and people out there that they need to catch up with and get them off the road.

I haven't been pulled for a roadside RBT in over 2 years now, while driving 50,000kms a year. They probably should get out more.

They already can, anywhere anytime, they only have to reasonably suspect there might be xxxxxx in the vehicle.

The RTA (now RMS) also have the power to do this to Trucks, not sure if they can do cars though.

Annual RWC would free up the extra time on just the cars, so the police might be able to attend call outs...or just bash a guys head into a brick wall.
(personal experience-funny 4 of them needed a turn each-really long story)

We don't need to give the police service any more powers. Some, (not all) have already let it go to their heads.

LOL .... Well I chose to mod my car so If I got pulled and checked AND failed .... you know what ? I'd deal with it and except the fact that it failed due to something I done. I modded it so if it failed any test its MY fault. Not the "system". We all choose to mod our vehicles. No one but ourselves are to blame if it fails a legal test.

I've been to some parts of the world that you're referring to. After being there trying to align those countries with ours when it comes to our police being able to search our cars seems somewhat ...... well ... unorthodox and extreme.

Its the Police doing a quick search and look around our cars for dodgy stuff people. NOT a take over bid by some overzealous underground conspiricy theorist. Once again I carry nothing illegal so I don't car.

The QLD Rego recognition gizmos are working well. The car fitted with the gizmo only has to drive past a vehicle of interest, and it sets off the alerts. Unfortunately it's often a Hire Company that hasn't got their car back by the due date and they report the car stolen, and they withdraw the charges once the customer pays them back.

There is the occasional good luck catch on the rego plate recogition system.... not just the unlicensed/unregistered... sometimes stolen cars are recovered.

Me: "Nup, get **********"

And so on.

Police have been trained to suspect anyone that acts strange, erratic and generally anyone with an attitude, it shows you could have something to hide. If you act like a **** accusing the police that you are the only one being picked on, what do you expect them to do? Let you go and apologise to you for inconveniencing you? What a joke. If you have nothing to hide, why act like you are King **** thinking you can do whatever you like? Remember, it only takes one or two idiots to wreck it for everyone else, remember, the police are people too, and I am sure they don't like the idea of holding everyone up on their holiday on the highway just to catch one or two morons.

I'm always amazed how the govt/police can get away with invading our rights to go about our business in a lawful way and we don't scream blue murder.

If we look at how the American forefathers such as George Washington set up democracy we can see that they went to great lengths to enshrine a private citizens right to lawfully go about their business and protect their property.

The English system is based on innocent until proven guilty.

Your motor vehicle is your private property. If you are breaking the law I have no problem with police pulling you over and throwing the book at you.

The problem with mass RBT is that you are lawfully going about your business and the police are adopting a policy that everyone is GUILTY until they blow in the bag and prove themselves innocent.

I don't like this as a principal and of course then some bright spark goes yeh lets start looking for other crimes in the name of road safety. THE PUBLIC WILL BUY IT.

The police are merely fishing. They are ERODING our rights with excuse that they HOPE to catch a few bad apples. But really they are saying we are all guilty until they are satisfied that you are not. A dangerous precedent.

They should not have the right to stop Joe citizen lawfully going about his business unless they have justification to interrogate further. A RBT is not justification.

Police should police. They should base their decisions on evidence. Not guess or luck their way to convictions.

So let me get this right... your saying that an RBT is infringing your right to drive drunk? Tell me how are Police supposed to catch people drink driving if they arent allowed to pull you over and breath test you?

You arent guilty until proven innocent when your pulled over in an RBT because thats the idea of an RBT is to catch you!

Do you wait until the driver runs into a tree? has an accident? then breath test him/her?

What about others drivers rights on the road to be NOT surrounded by people drugged off their skulls or drunk as a skunk?

Or are you saying people should ring up Police more often and dob in drivers more often? Good luck with that!

RBT has been around for decades, its not something new thats suddenly destroyed "your rights".....

The chances of a Police patrol seeing a drunk driver in the flesh is slimmer then running a booze bus somewhere near a night club strip or on a freeway where a lot traffic goes through and even then when they do pull someone over... thats just one driver caught as opposed to dozens caught in one RBT.

Way to miss the point. I'm saying that as a citizen I have the right to go about my business in a lwaful manner. I never said there were no benefits to RBT I just said that the principal goes against the foundation blocks that we built our society and laws upon. Innocent until proven guilty. RBT assumes you are guilty until you prove you are below the limit. Now Qld polioce want to do other police work at RBT's. It's the slow erosion of our freedoms that worries me.

Its a slippery slope. Where do you draw the line?

Well I do know something about you- you are the kind of person that believes police should be able to stop and search anyone at any time without requiring a reason- and anyone who doesn't willingly submit to your police state is a paranoid criminal who mistakenly thinks they have rights. Those are your beliefs. Thus "I imagine" the person who believes that wouldn't be too phased by a dictator either, one usually comes after the other.

And what if the cops happen to find a small bag of weed that one of your stupid mates or previous owner left behind and you get the punishment for it. Not to mention that cop searches can get real messy and if they damage anything you might not get compensated for it. All this could of been avoided if you kindly said "no officer i do not consent to searches, unless you have a warrant your more than welcome to". To answer your question no I am not a criminal and have never committed an offense, i just don't appreciate my car or house getting ripped apart.

That is because they have 5 police officers concurrently in the line.
