Advice for speeding, loss of license

oh sorry i mis-read your question..
i think that specific part of the law has been phased out.. and now its just the speed your doing vs the zone your in..
back in the day, my dad also got done for 130km/h, lost his licence for a month..
but a few months ago i know of someone that got pinged at 145-160km/h (in a 60zone).. he got a 2 years suspension, and a $1800 fine.. wasnt a P plater either..

What was i going to contest, i was considering maybe something along the lines of first time pulled over, out of character and the reason why i was actually speeding it. But from what ive read, that pretty much is a no-no for a P plater. So coping it on the chin looks like the best bet.

All speed reading devices have a margin of error that they are obliged to apply. The last time I checked (here in Victoria) the margin on a radar gun was a flat 3kmh. To this they are also obliged to give an allowance for the margin of error on your speedo which I think is about 10% (check against NSW law on this). This brings you down to an official speed of 108kmh. I don't know what your "safety" story is, but if its legitimate then that will almost certainly be taken into account too.

As well as this, I would be looking to do whatever I can to show remorse like doing a road safety course before my court case.

This may or may not make a big difference given your P plate status, but every little bit helps and its something to hang your hat on. I would also be be getting some professional legal advice on this.

To everyone else who might think that I am supporting irresponsible driving, I am NOT condoning what he may or may not have done but I will not pass judgment because I don't know the circumstances and everyone is entitled to the same breaks in the eyes of the law.

Finally, for all those who are may be tempted to go racing on public roads, DONT! Join a car club and do it on the race track. Its the best fun you will ever have, it will be safe and you will become a significantly safer driver for it on the road.

I went to court today for a speeding offence so heres some information I can give you.

You can not progress a licence (eg P1 to P2) with a driving issue not resolved.

The magistrate dismissed a case where a man with a clear record since 1977 for a low range speeding offence, but upheld a case where someone had a clean record since 1987 and got done for being 0.05 BAC.

If you want leanency you plead guilt and asked to be sentenced under section 10. That means you are found guilty pay a fine but still able to drive as the conviction is not recorded. To ask for section 10 you need a clean record for 10 or so years and it has to be low range (being 0.05 BAC or doing less than 15km/h ect). You can not ask for it purely based on you needing it for work. (You can ask but they will deny it).

I am pretty sure that if you lose your licence or get suspended while on a restricted licence (L, P1, P2) you have to resit that test and then start the x amount of time again for that licence. If new laws have been introduced (like what cars you can not drive due to there power) you now have to abide by them.
