Victorian man has become the first driver to permanently lose his car under the state's anti-hoon laws.

In a hearing at the Castlemaine Magistrates Court yesterday, Terrence Lord, from the central Victorian town of Drummond, was ordered to forfeit his blue 1980 Toyota Corona fastback.

Lord, 43, pleaded guilty to four counts of driving while disqualified between January 23 and February 14 this year.

Under laws introduced in July last year, drivers caught drag racing, doing burnouts or committing other "hoon" acts such as reckless speeding and driving while disqualified, can have their cars impounded for 48 hours for a first offence.

They face a three-month impound order for a second offence and the permanent confiscation of their car for a third offence.

Victorian Police Minister Bob Cameron today welcomed the magistrate's order.

"These tough new laws hold hoons accountable for their actions and hit them where it hurts most - by taking away their vehicle," he said in a statement.

Well there goes all the media's stereotypes.

I thought the new laws were for hooning and anti-social behaviour on the roads? So cars can be impounded permanently for repeat traffic offences (I thinking driving while disqualified is traffic?).

Was the guys car impounded for the 48hr and 3 month periods first?

I don't mind the hoon-law stuff so much but taking peoples cars for repeat offences nothing to do with hooning isnt cool.

What this has done guys is set a precedent. Smart thinking. If it was a Porsche there would be a huge legal battle and potential for the law to be struck.
As it is a piece of junk then they will just take it. If the owner resists then all the better as they then have more ammo to increase the severity.

You Victorians voted for this so don't complain when they take your car because it looks like it might be a bit hoony.....

N.B. The owner should be filling the car with prawn shells, battery acid and ebola plague then welding the rims to the axles and welding the drive train solid.

OK, I am just having a short anarchy rant about the popular peoples democratic socialist republic of Cactoria and its junta in Stillborn, the capital (note the spelling is capital as in the money bucket not capitol as in place where leadership resides)..... /better now.

WEll it definately shows that it can be all ages that get stung by the hoon laws. will the media coverage be different in this case as compared to if it was a young male drive aged betweeen 18 and 25??? i guess we will never know. But the hoon steretype will remain, young men (and women).

I suppose this bloke thought he was above the law and paid the ultimate price... This will "hopefully" make those who have been warned realise that if you are caught there is no excuse...

No that would be a dangerous criminal act that might hurt someone (not that ebola wouldn't but it is a bit hard to get locally and was said as satire) and would do the cause more harm than good.

Making it an absolute pain and cost the plebs more will have a much better effect. If it loses money they will stop doing it, if people get hurt they can extend the budget because they have the "moral high ground".

Lets face it, the guy is a loser, no amount of Court suspensions/fines was going to stop him driving under suspension. 4 counts in 3 weeks.
He obviously kept losing his license for DD and driving under suspension so it's better for all of us not to have him on the road ****ed under suspension and pranging into our cars/family.
It's just a shame his cars a junker, he can go buy another POS for $200 and keep driving.

Do you consider driving whilst unlicensed good social behaviour? I don't thinl it is a bad thing at all that they impound (permanently after the third strike) cars for this type of offence.

The car is worth nothing - he is probably laughing he got off so lightly...he should pay a massive fine and/or go to jail. Where is the justice between this clown losing his $10 Corona and the same guy doing it in a Porsche worth $250,000?

This law will penalise people unfairly based on their socio-economic status.

They won't take your car just because it "looks like it might be a bit hoony."

This is all about making people responsible for their actions. If you are caught doing burnouts, donuts, rollbacks, handbrakies, driving without a license or whatever else on public roads, then you deserve everything you get.

If you drive sensibly, then you have nothing to fear. Simple, isn't it?

People seem to forget that a license is a privilege, not a right.

Not true.

Lets take two people. A and B, A earns $60,000 per year while B earns $600,000 per year. A has a $30,000 car while B has a $300,000. If both people get there cars confiscated they lose 50% of a years earning.

The majority here just dont get what sort of dangerous precedent has been set obviously.
The fact that "unlicensed driving" now falls under hoon laws has opened the floodgates for the government revenue collectors. Its inevitable that speeding and unroadworthys will now be counted as hooning. Dont think so? Well, the hoon laws were originally put in place to curb "dangerous and antisocial behavior". It was all about people driving in a manner that causes direct threat to the population and property around them. As much as unlicensed driving is stupid and illegal it does not, in its own right, create a direct threat to anyone, no more so than any other car on the road. Now that it is considered "hooning" then the path is clear to make anything illegal in a car a hooning offense. Speeding.. we have it rammed down our throats every day it is almost premeditated baby killing. Unroadworthy vehicles? Well, if they are unroadworthy they are unsafe.. direct threat to people and property there. This case has set something in motion that will be abused and profited on in the future.
I can see a LOT of cars getting taken away in the next few years. Obviously the reliance on speed camera revenue is not enough, we are now officially screwed.

Seems that the term 'hoons' is being confused with idiots who regularly drive dangerously or drunk.

To me hoons are those who are having a bit of fun in the right place where there's no danger to anyone else.

You think this will never happen? When I was 8 years old myself and my friends all had slug guns that we used to play with shooting tins in out back yards at about 10 yards because by 25 yards the pellets all fell out of the sky. This was fun and no one ever got hurt. We never shot at each other because even as 8 year olds we know that it was dangerous to do so and were responsible enough be trusted.

If you were to do this today there would be 50 police cars and the TRG turn up along with CH9 and twacey doing a story on urban terrorist training cells.

There are protections included in the new laws to protect civil liberties.

The situation you describe would not result in confiscation. Stop being alarmist. The only people who have to fear losing their cars are the people who are idiots on the road. Pure & simple.

In Victoria you can renew your license over By Bpay, Telephone or Mail if your picture is on file.
Many Australia post Country shops now do the photos.

Interesting to know why he lost it in the 1st place, maybe drink driving or being stupid either way he should have been on the road, and he knows it.
He is a victim of the 3 strikes your out, so he knows the system having been through it already 2 times before this..

I agree he shouldnt be on the road, I doubt anyone would dispute that. What concerns me is the legal "creep" happening now in regards to the "Hoon" definition. If unlicensed driving is Hooning then the scope to make other offenses hooning too has broadened considerably. This concerns me greatly as we have, as car enthusiasts, been in a long running and ultimately losing battle with the Scruby's of the world to be wiped out and turned into Camry driving robots.

Unless someone CLEARLY defines what is considered part of the hooning laws then the courts get to set precedents.. and these become the laws.
