HE was showing off his driving skills to colleagues – reaching speeds of up to 240km/h on a freeway in a fully marked police car.
But after his fellow constables reported his behaviour to superiors, Senior Constable Andrew Robert Cumming found himself on the wrong side of the law – for driving the speedometer off the dial.

The 30-year-old yesterday pleaded guilty to two charges of exceeding the speed limit by more than 45km/h on separate days.

Cumming was a specialist highway patrol driver attached to Operation Seta in January last year. Seta was formed to target anti-social behaviour in response to the Cronulla riots.

On January 18 last year, Cumming was driving on the F6 near Bulli with two constables. He explained how the Holden Commodore worked before accelerating to a high speed.

One constable saw the speedo reach 202km/h – although he felt it was going faster – and asked Cumming to stop driving.

According to the constable, Cumming said: "Don't worry. That speedo, it stops at 202. We were actually doing 230-240km/h."

Just two days later Cumming was driving with two different constables when he reached at least 202km/h on the same freeway and overtook about 30 other cars while travelling at that speed. In both cases they were not driving to an urgent police job.

Cumming's barrister Les Nicholls yesterday told Sutherland Local Court that although his client offered no explanation for his behaviour, he was extre- mely remorseful.

"He accepts it was the most irresponsible and recklessly stupid act that he has committed and is extremely remorseful, contrite and embarrassed – not only personally but professionally," Mr Nicholls said.

A DPP solicitor told the court Cumming misused a police vehicle and abused his position of trust.

Cumming was told to pay an $800 fine for each offence plus $67 in court costs.

His licence was suspended in June last year. For the first charge magistrate Antony Townsden suspended his licence for six months, which expired last December. For the second charge Mr Townsden disqualified him from driving for a further one year until December 7.

Mr Townsden described Cumming's behaviour as "gross carelessness and stupidity" which put other lives at risk, telling the court it was the highest speed he had dealt with.

Cumming – who was removed from his position and put on restricted duties – has been an officer for seven years and in the past has served as a volunteer for the RFS and SES.
Clocking a car on the F6 it seems ,hope it was worth it ;)

They should suspend him. He is supposed to be setting an example for every other road user.

They go on about P plate hoons, and look at this completely irresponsible behaviour.

If that was anybody else, they would lose their license & car. So how is that fair...

No, it was ON the F6 freeway, and it was IN an SS Commondore. They took his licence for 18 months - as a traffic cop, pretty harsh penalty and I doubt he'll go back to any car related duties. Why would they confiscate his car too? This was in NSW, not Victoria.

I don't understand why this idiot wasn't fired. For speeds like that, on more than one occasion, endangering as many people as he did - the moron should be in jail.

A few months ago here in Mareeba, there were a few cops behind a post with a speed gun gunning people driving into town. Fair enough I thought. Then I saw the cop run out onto the road as if to direct a car to pull over, and then he stopped and walked back to his former position. Needless to say I was a little mystified, until a police car then drove past. Bloody pricks, shouldn't he have been booked like anyone else?

Honestly was it that dangerous???
Ive gone along the freeway with little or no traffic at 160+ Ks & have had no worries at all at that speed.
Yes I know its breaking the law & Im very noughty. But for god sake common sence has to prevail here. If there was heavy traffic,then yes hes a dick. If it was 2am & not a car in sight. Weres the problem ? other than it is against the law, but so is drink driving & theres plenty still doing that.

The only thing I can see he did that will cause an uproar, is he's a cop & I bet hes booked plenty for doing the same thing.
Thats were the 110kph law is a joke.

The hume hwy is the perfect example of this.
We came back from VIC last month, & on that hwy we could have been traveling in complete safety at 140-160kph without a worry.
I know theres some places you couldn't do that speed. But for most of the trip you could.

The cop should have known better for sure, & it puts the other cops in the gun with the public. But let not get into cop bashing.

he was fined and he lost his license for 18 months. i dont understand why the speedo said 202km but he was doing more like 240km. what model was this commy? also this proves now that more commy drivers are hoons lol

Reminds me of a time at school doing 'Automotive Science' and we went to the road out side of the campus to do a speed test.

We had a group at the top (school was on a fair hill) and one at the bottom to do a distance over time test.

A cop went past and about half way down worked out what we were doing. Needless to say he topped the list speed wise.

Yes, the F6 is he freeway between Bulli Tops and Heathcoate (Wollongong to Sydney). I travel on that road everyday, and its far from safe doing 200km/h+. In actual fact, over recent weeks the RTA has been digging it up relaying new tar. It's got more pot holes than the Bommerang Golf Club carpark!

may i ask why he is still on the force?

and how can you be remorseful when you've committed the crime more than once. wouldnt you do it once, feel remorseful and never do it again. he's only remorseful because he got caught. what if the other officers didnt dob him in?

I agree, while the cop shouldn't have been doing it, but our speed limit of 110 is a joke when you drive cars like ours Sbutler, sure in some cases it suits, but as anyone who has tackled the nullabor plains will tell you (Spelling?) 110Km/h out there is not enough, hell on the 140Km dead straight section i think upward of 160-180Km/h would be safe during the day time (Night would be suicide)

Silly copper though, just asking for trouble with the media and not setting the best of examples...

No i reaslise that is why we have the speed limits set so low, so that it's not only safe for my car but the family in the XF Wagon aswell.

What makes out cars differnt?

Well He drives a T3 and and i drive an XR8, you work it out :evil3:

and i drive a worked v8 with no speed limiter... the only difference is they sound louder, when it comes to high speed.

i agree, when you are doing 160+km/h and the old corolla is doing barely 110. you come around a sweeper and clean up (npi) this corolla, it will be theyre fault i guess....

What gets me is, driving back from kyabram one day, a marked HP car appeared behind us (sky blue 90's courier-the smurf) and sat right up our asses for 2 minnutes and sped off around us, he was over the horizon in about 30 secs, Its nice to know he can do this without being a road terrorist...

Can my car be impounded, immobilised or forfeited if I am caught speeding?
Vehicles may be deemed to have been involved in hoon behaviour if they exceed the speed limit by 45km per hour or more. Drivers who have received a speed infringement under 45kmph and incurred no other offences cannot face impoundment, immobilisation or forfeiture of their vehicle.

If my child is caught hooning in my car, can my car be impounded, immobilised or forfeited?
Yes. Victoria Police may impound, immobilise or forfeit the vehicle used for the hoon driving offence, regardless of who owns that vehicle.

That would put a different slant on it for sure!!
Again doing 202 kph & passing 30 cars is silly & dangerous.
