Default Selling a defected car

Hi everyone I'm new here and I'm sorry if I posted this in the wrong section. I have a classic Ford that I acquired years ago, it was defected and swapped a going car for it. Firsty I need to sell it but don't know how to go about it because of the defect. Secondly I need to know the appropriate value of it. It's a Ford XA coupe with GT parts ( it's not a GT) it does have a fair amount of rust, interior is in really good condition. I'm older and not sure how this forum works and hopefully I can get back to my post!

If it's unlicensed you can sell it if you've handed in the plates.
The purpose of the defect is to have it examined, which is what will happen anyway when new owner has to get it registered.
If it's registered I believe all you need to do is declare it's subject to a defect notice.
When you put in transfer papers, obligation shifts to new owner to deal with.
That's how it works in WA anyway.
As for value, too subjective.
You'll get the usual, "how long is a piece of string" or " what ever someone's prepared to pay".
Rust is the decider, maybe auction it.
Coupes are hot property if they're good.

Which state are you in? There are different rules for each state.

How long ago was it defected?

It was defected just over 20 years ago, I'm in SA. But it's not in my name.

I’d suggest quietly checking the engine and body numbers against stolen vehicle databases across all jurisdictions.

If it passes, and nothing shows up on the PPSR check, then definitely attempt registration. As the car is something of a mutt (but in a good way, it sounds) there’s no point trying to capitalise on the “barn find” mania that seems to apply to vehicles with better provenance.

Yeah 20 years ago it won't show on any database unless it's stolen.
Pretty sure in NSW if it's unregistered for 12 months the vehicle gets deleted out of their system, I don't imagine other states are any different.
If its full of rust it might be hard to rego I would think.

Remember that a restoration on something like this can run into the $100,000+ range then what's it worth, not much more than that, Just call Grays, it will go for drug money, and they wont care if its registered going or in 1 piece, only thing is that with a Auction you have to be happy with what you get, as in it might not hit the value you think it is worth.

At the end of the day it will be worth what the highest bidder pays for it whatever that may be.

It isn't stolen as the last owner gave us the rego paper and defect notice, it was also advertised in the trading post, I have the add cut out from wayyyy back

It has rust in the boot seal and the (firewall?) It's in great shape and has been garaged for 20+ years. I'm hoping for a decent amount but not too greedy. I have contacted greys but in my state they are not allowed to sell a defected car, which doesn't make sense to me when they sell cars without number plates..

How do they know it is defected, if the SA rego authority don't have records going back that far.

I think you have bigger problems than a 20yo defect.

If its valuable, it will need provenance.
There will be nothing stopping the previous owner or their descendants claiming ownership if you dont have an actual receipt. I suspect an auction house won't want anything to do with it based on that fact.

It's no different than if you had a valuable painting in your possession and couldn't verifying ownership.
Basically it will go back to the last known owner.

if it has not been listed as stolen and he has owned it for 20 years, then a quick stat dec will tidy that part up real quick.

It's 100% not stolen, I might add that I'm female and trying to do this by myself. It's not easy when I don't know what I'm doing! Would the engine number be what's on the ID plates as I wouldn't have a clue where to find it on the engine?

Are you the same person as the person who was on here last year saying that their partner had recently died and they told you that AFF would be more than helpful?

If you are, please let me know. I, along with many others on this forum, get a little suspicious of a member who has multiple usernames. I hope if this is the case, it is a simple oversight.

My partner did pass a few years ago but to be honest I don't remember if I ever posted on here? I have tried asking multiple people on information about this and I've lost track on who I've asked. At first we thought it might be a super bird (if that helps) I did contact Ford Australia but because the car is not in my name that couldn't help me.

I reckon you need legal advice...... are you a member of the South Aus RAA ?

A bit of personal experience. I bought a QLD rego'd car and it had to be registered in NSW.
The seller and I did all the right things, diligent documents etc. When I presented these to the NSW RTA, they were not interested in any of them.
They wanted a Stat Dec from me detailing all relevant facts, previous owner, address, rego number, VIN and lots of other info.
None of this on the Stat Dec was checked to our documents by the RTA.
The Stat Dec is a legal document and if any of it was untrue and found out later, the 'criminal' consequences were on me.

As for the defect from 20 years ago. Forget it.
There would be any number of additional defects now, after sitting for 20 years. Tyres would be the first.

Look, not to throw fuel on the fire but if the car has been sitting for 20 years, there is no way in gods green earth you will be able to get it registered in a week, just off the top of my head there will be stale fuel, leaking wheel cylinders seized brake components, crusty rubbers, seals etc, time is not a cars best friend I'm afraid and there will be a lot of work that will need to be carried out just to make it run, then there is a heap of work that will need to be done for registration.

it might vary from state to state, but a stat dec is a legally binding document and once produced it covers the information that is missing.

I have registered many cars over the years using just a stat dec as proof of ownership, never had a problem, have been anything from cars given to me to people who never paid their storage bills, there are processes when people ghost you and wont give you a transfer, if you have to acquire a car the legal way when the original owner owes you money for repairs, there is a process that you have to follow, but that would not be necessary in this case a stat dec will be all you need outlining the way it was acquired.

Thank you for everybody's help and input. I did bite the bullet and tried to register it, it still has the defect on it so I did not get it registered. I think my only option now is to ebay it as parts only but the car to be sold as whole car.
