Default Advice needed

Helpful advice would be really appreciated on this topic, and if anyone has experience or legal advice that would be cool too. Ok, heres my situation.

I have an XBGT coupe stored at my parents house (thats it on the left), about 12 months ago while i was at uni they split up. Now that i have a place to put my coupe my father wont let me get the car, he says i owe him money i dont owe. I have old rego papers in my name, insurance papers in my name, and keys for the car and shed its locked in, but says its not going anywhere.

I called the cops and they didnt want to know about it and said to call a magistrate, which i did, and they said as long as i can prove its mine and dont break in i am ok legally. Does anyone have experience or know of a situation like this and could offer advice? as you could understand i want my coupe. SO yeah, thanks in advance

Domestic disputes are never nice. However, he can't be home all the time (especially over Christmas). So it shouldn't be hard to find out where he is going over Christmas, and liberate the car while he is not there. No harm, no arguements.

Looks like a nice coupe too.

man that sucks...I know what its like to be in that situation.

It all depends on how far down the track your relationship is with your dad. Maybe its clicked that the car is worth a bit and doesn't want to get rid of it.

Talk to ya dad, if his not helpful then id be getting a lawyer quick smart.

Its unlikely to be resolved easily, tried the talking thing and he wont budge, says mum took all his money so he wants mine basically. Thanks for the input guys and gals

Yep. Go in and get it when he's not there. Maybe let the local police know in advance that you are going to get it, and take the ownership papers with you just in case.

It's not an easy situation. Is it alot of money? Maybe you can work out an installment plan to pay it off. Give him the first installment get into your car and drive off giving the rest by that I mean the finger .LOL

Appears to be a civil matter on the surface. I cannot see any obvious criminal offences. Best to seek legal advice. Most likely he is claiming you owe money for storage of the car etc. Do not break in, that would considered burglary or the very least, unlawfully on premises. I would try and resolve it through mediation but if this unsuccessful speak to your local court.

If you got the keys to the garage (you mum can vouch they were given to you) and you have up to date papers proving its yours, then go and get it when he is down at the Woodport Hotel! :

If it all falls on it's **** ring the cops, report YOUR car as stolen, tell them it's location :evil3:
Or get a car load of mates and go pick your coupe up.

Just take your property back...its obvious your dad is an arseh#le...he can't afford a legal fight your mum has him on the back foot with that.

Take a few mates when he's not there...car trailer..load her up new secret location...bobs your uncle and you know nothing!!!!!!

WE need an Australian Judge Judy, she would stare him down tell him he's an *** and give the car back, i had a similar situation with my Dad, we didn't speak for some time, i finally went to make peace with him and he died suddenly 2 weeks later, don't do anything you will regret.

I am always thankful that I have a pretty good relationship with my parents, makes life easier that way.

If its your car and you can prove it, I would seek the best legal advice and recover the vehicle that way.

And another thing, i have the reciept from the guy i bought it off, but its not made out to anyone. Does anyone know how much stuff you need to prove ownership? thanks all for the input

Current registration papers show ownership...If not current the car is obviously out of reg, so the last piece showing reg should be enough...
You could be a little sneaky, if the car is out of registration, go and register it!

Seriously though, you need to seek legal advice and quite quickly...your dad could sell the car as its on his property (sold as unregistered - no actual papers needed)....So while on the comp, check out solicitors in your area and give them a call...

The car CANNOT be registered unless ownership can be proven (i went through that at the RTA with my ford).

But you can notify the RTA in advance warning them so they will have it on their database as non registerable. If its been out of rego for more than 3 months or it was last registered interstate then it will need a blue slip!

If you can get it registered without a blue slip DO IT ASAP!!!!!!

yeah in a way it is basicly stolen, send him a nice fake letter from some made up law firm and put phone numbers and the lot on it, use fake head notes names n send it to him trust me my bug catcher has all fake permits and i show the cops weekly i even tell them to call the number, confidence is everything here, another tip when you put his name on the letter (first or last) and it is one of those names which 40% of people spell it incorrectly then spell it wrong. musnt hint that it could be you, have your side of the story in it and his

Unfortunatley its been out of rego for about 2 years to save some cash, but i called the rta and they said that the last rego slip has to be signed by me to be sold, but if he does something dodgy than maybe i will help myself to his prestine xb gs fairmont and xr8. I think my brother is gunna help me get the coupe over xmas.

I should be fine i think, i have shed keys (if they still work) car keys, receipt from the guy i bought it off, old rego and pink slips and greenslips and insurance papers in my name. Thanks all for the input

Any update on this xe351? It would be great to have the car back by Christmas, a nice little present for yourself.

As a Ford fan I'd appreciate a summary of your GT (options etc) if you're cool with that.
