not wearing P plates loses your lisence??

I just got done for not displaying P plates while on my P1 lisence (i had forgotten to put them on after i used them on another car) and the cop said it caries no demerit points. I go to pay the fine at the transport SA office and the clerk tells me my lisence has been cancelled and i will get a letter form them in about a month, up untill when i can still use my lisence. He said i can appeal to have my lisence extended, does anyone know what the procedure is for that? I CANNOT lose my lisence as i am a pizza delivery driver and it is my only job, i will be ruined, broke and most likely homeless if i lose my lisence. I simply cant believe such a minor offence makes you lose your Ps immediately when speeding 20 km/h over the limit does not. Can anyone help me out with some info on the matter?

man that sucks about the homelessness. id get the authorities on the line pronto rather than ask the internet. get it straight from the horses mouth and maybe even mention that you have pizzas to deliver or something

Why were you pulled over? were you (have you been) booked for anything else?

i have no idea why i was pulled over, i was driving with the cruise controll on 60 km/h, they pulled me over just randomly. I have never been booked or even warned for anything else

i payed the fine today, i was pulled over yesterday so i payed the fine as quickly as possible. IM kind of shitting myself now, as far as i know the magistrate is not required to accept my appeal so if he/shes feeling like an ill lose my lisence anyway..

The police run plate checks all the time, they even have a camera that reads plates and does the checking for them automatically, it probably flagged the car belongs to a P plater, saw no P plates so investigated.

Doesnt SA have work licences?

Does seem very unfair to lose a licence for a trivial matter like failure to display a p plate, especially when its your first offence.

To be fair to the system though, the reason youre losing your licence is failing to obey the law, the p plate is just the particular instance. P plates are probationary/provisional, which means youre on your best behavior, its why you have limited points. That best behavior is not evident when you stuff up is it?

Still, seems the law that allows you to do 20km over and keep your licence, yet costs you it if you fail to put the p plate on is unbalanced. Makes no sense really.

and if it was a trivial $20 fine, would you bother putting p's on your car?

i sure as hell wouldnt. and since my car is in my dads name, i'd probably never get pulled over and stung for it, if they do a rego check.

by the looks of that handbook linked, 20km over and you do lose your licence.

It actually reads like any road with a posted limit of under 100kmh and they allow you upto 10km over before you lose your licence for the one incident.

But there is no tolerance on roads where the limit is 100 or more.

Back when i was a P plater 90% of the time they were up, as were most other people that i new as well. Is not having P plates up putting life's at danger NO it isn't. All it does apart from let other drivers on the road no you a new to driving is turn the car into a beacon for Cop's having a bad day.

It blows me away that, you can be DD and get a 3 month driving suspension, and if you forget to put up P plates and are driving a road worthy car doing nothing illegal behind the wheel you cop the same as if you were DD.

It is correct to say we do live under bolshevic communist laws. There is not much you can do about it. Id try to get a work licence,etc. do what they say appeal as much as possible.

dude. my mate lost his license for that you appeal to court and they will give it back straight away. when he went in they said that it doesnt harm anybody. the only thing is that you cant appeal for another 5 years. so if u lose it again thats it you cant appeal. in saying that get all the help you can like get a letter from your boss saying you need your license for your job. and id be very surprised if you dont get it back.

ohh and also you can get a temporary license pending trial.

isnt it the drivers responsibility to make sure there are P plates up if you have to display them?
isnt it the drivers responsibility to make sure you carry a license?
isnt it also the drivers responsibility to make sure all passengers have their seat belts on?
shall i go on?
making sure you have P plates displayed is a part of your license conditions in which you broke, just like if you had have had a swig of Jimmy and went for a drive.
try the appeal, you should get it.

My workmate got done for no p plates earlier this year or maybe late last year. He was in a work van that he doesn't usually drives and just forgot his plates. That was a loss of license and it was his first offence. You will need to do what has been said above. Make sure you get your boss to write a letter stating that you need your license for work and take it with you to your court appearance. They will send you a letter in a month or so saying that you have to go to court just take the letter and appeal it. My workmate did this and he now has to keep his p license until 2010!! You might want to ring up Transport SA and just make sure you don't have to do anything special to get a court appeal happening. I am pretty sure you don't though I think they just send you a summons or whatever it is called. It usually takes just long enough for you to think that you have gotten away with it and then it turns up.

im pretty sure they dont send you a summons. you just set a court date. you only get a summons when u choose to be prosecuted lol. i was stupid enuogh to do that...11th december ill get raped!

BREACH OF P1 CONDITIONS

* disqualification from driving for 6 months, and
* cancellation of the licence

AFTER DISQUALIFICATION

Where a P1 driver chooses not to appeal or is unsuccessful in an appeal against breach of conditions, they will be required to re-apply for a Learner’s Permit. Although the theory test does not have to be re-done the practical driving test must be. There is no time limit for how long the Learner’s Permit must be held but in practical terms, because the test must be booked through a driving school, there will be a waiting period of about one month. A P1 licence must then be held for aminimum of 2 years (in addition to any further period ordered by the Court). Any period served on a P1 licence prior to the disqualification period will not be counted towards the minimum 2 year period [see s 81A(3)(b)].

In addition,

* a curfew* prohibiting driving between 12:00 am to 5:00 am unless accompanied by a Qualified Supervising Driver may be imposed on the licence for 12 months when driving recommences after the relevant disqualification period has been served.

* Imposed where a serious disqualification offence has been committed.

so if you do loose yours you need to reset your L's which i believe now include 100 hours driving before you can sit your P's which you have to start over again for 2 years... im glad i hit 25 before i finish my P's so i get fast tracked (according to QLD law)

yeah i know. i pretty much got no chance of keeping the license. they reckon i was doing 134 in 100. yeah on Ps and yeah im going too lose it for sure i can only hope they will give it back to me for work. i dunno how it will work coz im not on P1, P2 im jus plain old Ps. my cousin kept his for doing 115+ in a 50 zone. beats me how :S

Well when I was on my Ps I got done for 137 in a 100 (110) zone and had no P plates. I appealed with a letter from my boss in court and I got my license back. That was a few years ago now though, think it was 2000. My work mate was on his normal Ps as well but now he is on the new system of P1/P2. If you have a work uniform maybe wear that to court it might help maybe? Good luck with it anyway.

What gets me though is the fact that if you appeal, you then can't appeal for the next 5 years, even if the original appeal is successful.

For example, take that chick that got done for speeding on Citylink in her Datsun when the car couldn't possibly do the speed she was doing (it was a few years ago, bit vague on the details). She appeals, gets off, but can't appeal for 5 years (if in fact that is the rule in Victoria)
