WA Police to Review 53,000 Speeding Fines.

"WA Police have suspended the use of 11 new mobile speed cameras and will review more than 50,000 infringements after a motorist was incorrectly charged with hooning and had her car impounded.
It is believed the woman was accused of driving at more than 160 kilometres per hour on a Perth freeway.

Police said the cameras in question have caught 53,000 people speeding since they were introduced in January — with a manual screening process later identifying 20 cases affected by the fault.
The woman's case slipped through the screening process and resulted in her being charged with hooning and her vehicle seized by officers, police said.
The driver disputed the speed reading and after reviewing the case, police dropped the charge and returned the car.
Police said the computer programming fault with the new cameras was not identified during pre-rollout testing.
In a statement, State Traffic Commander Scott Higgins said a review of the traffic infringements issued by the cameras was continuing.
"We have checked all infringements resulting in vehicle seizures or court proceedings and we are satisfied these have been correctly issued," Commander Higgins said.
"All other infringements issued by the new cameras are now being manually validated to ensure no one else has been affected."
He said not other speed or red light cameras were affected.

I got flashed the other day a few kms over when I was concentrating on the road, not my speedo. Was doing a similar speed to everyone else, I’m sure he got a fair few people. I turned around and went up the road and put out a sign I keep in my car that is high vis green with “speed camera ahead” in big letters.

I sat there for about 15 minutes. I saved more lives than that poxy camera. I reckon a few hundred cars slowed down and gave me a thumbs up or a honk. Anyone who argues that this isn’t blatant revenue raising needs to pull their head out of the sand. If they put a sign up prior to a camera, people would slow down. Sure, keep the camera to catch those who ignore the sign and are inattentive, but don’t hide it in the bushes, that just boils my ****.

"Only the dilapidated state of her 2004 Hyundai Getz saved Chloe Osborn from a likely criminal record and driving ban.
The 26-year-old single mother of two, from Calista, was falsely accused of speeding at 162km/h on Kwinana Freeway last month after being snapped by a faulty mobile speed camera.
Her case prompted WA Police to suspend the use of the 11 new cameras and review about 53,000 infringements for other mistakes.


Although Ms Osborn has been cleared, she is still counting the emotional and financial costs of the stressful days her car was impounded and she was facing a charge of reckless driving.
Ms Osborn was emotional yesterday as she recounted how she protested her innocence when two detectives turned up at her door early last month to question her about the hoon allegations.
“I told them, ‘I don’t drive like that’,” she said. “I’ve never had a speeding infringement.”
She also knew her car was not in a good condition and unlikely to reach such speeds.
“But the police were so certain,” Ms Osborn said. “I asked, ‘Are you sure your cameras are accurate because I know I wasn’t doing that speed’ and they told me their cameras are 100 per cent.
“I felt like I didn’t stand a chance. I’m a single mum with two kids and I really rely on having my licence and a car to get to work and study and live. It was a horrible position to be put in.”
The detectives told Ms Osborn she had a week to hand in her car for a 28-day impoundment and that she could expect a court summons for reckless driving.
She and her father sought legal advice and decided to fight the allegations.
Before handing the Hyundai to authorities, they had it tested. The results showed the engine struggled to reach 145km/h.
Ms Osborn said despite the test results, police initially told her lawyer Terry Dobson that they were pushing ahead with the prosecution and she could argue it in court.
But a few days later, they told Mr Dobson the matter had been dropped.
Although her case did not reach court, Ms Osborn stopped attending her nursing course while under the threat of a criminal conviction and cancelled a home building contract.
“I just couldn’t see the point of studying because a criminal conviction could make it very difficult to get a practical placement or a job,” she said. “And I couldn’t work for the nine days my car was impounded because I do agency work in aged care, where they just call you in the morning about shifts.”
Ms Osborn also pulled out of a planned house build because she thought she would need her savings for the impound costs and lawyers.
“I’m trying to get my life back together but it was pretty stressful,” she said.
“I just thought of the worst-case scenario.”
WA Police covered the impounding fees and have promised to work with her about her other costs. Ms Osborn said that after the allegations were dropped, police told her father someone would get in touch with her about returning her car.
But she claimed she heard nothing and after a few days called the vehicle impound unit herself and collected the car.
Mr Dobson revealed the high-speed testing had damaged Ms Osborn’s car, prompting her to get another one and he hoped WA Police would cover expenses she incurred from their mistake.
“Chloe has done nothing wrong and she should not be left out of pocket,” he said.
Mr Dobson said any driver who received a speeding infringement notice should review the matter carefully because speed detection devices were not always accurate and reliable.
WA Police Cdr Scott Higgins said police had suspended the use of the new cameras and were reviewing all infringements issued by them to maintain public confidence in speed cameras.
He said the fault did not affect the rest of the speed or red light camera fleet. "

It does, an asset can only be forfeited to the Crown if a court has ordered it. Or are you talking about impounding a car?

There was a camera installed in Vermont Melbourne last year, Canterbury Rd/ Mitcham-Boronia Rds intersection they are regularly doing work on it. I would love to know what the issue is.

A good few years ago now but I was over in Perth visiting an old friend when a report came on the radio about speed cameras in WA.
The message was that revenue went down from the previous year.

You would think that was a good thing as people were getting the message.

But no, the police spokespersons message was "What do we do we have just lost three million dollars"

Impossible to have any respect at that point.

The elephant in the room that is being ignored is the 53,000 infringements that have been issued. What other 'crime' occurs in that number and the public isn't outraged about it? Imagine 53,000 assaults, break-ins, robberies or murders is such a small time frame? The public would be up in arms about it.

This situation serves to demonstrate two issues in my opinion;
1. Speed limits are too low
2. The camera's are not a accident reduction tool - they are a revenue generating tool.

I wonder if these apparatus comply with S10 of the National Measurements Act 1960?

If theres any doubt the all 53,000 infringements should be cancelled.
I do think the lady in question jumped off the deep end though, stopping her studies and cancelling a housing contract, particularly when she knew she'd done nothing wrong.
As for revenue raising, agreed. Fines don't work but demerit points hurt. I got flashed recently, sweated on it for the 7-21 days but when it arrived it was 100 bucks and no points, pfft no impact on my living standard or licence status.
Road safety, debatable. Imagine no deterrents on the roads, I'll be the first to admit my daily commute would be done in half the time and I'd think about buying a faster car. My chance of catastrophic injury would rise accordingly though.

Did you see with the introduction of that new trailer thing (it was at bullsbrook recently) that they WILL be issuing fines while it is on test?
