customers rights?

anyone know what the legal requirements are when a customer purchases an item that is individually pricetagged at say $9.99 and when its scanned turns out to be dearer?

Pay the price thats marked on the item and even cheaper if it says 5/10/20% off marked price, shops fault if its not priced right UNLESS someone has changed it themselves bye adding another price sticker.

(The scanning code of practice is voluntary for retailers to abide by)

Basically if it scans higher the retailer has the right to choose to sell it to you for the marked price or withdraw it from sale (in other words, take it behind the counter and correct the sticker).

Also, remember that it is not always the retailers fault if a product is marked with the wrong price. Other customers (aka thieves) change price stickers and sometimes leave the item if they decide not to steal it. Annoying scoundrels also come into stores and change the price stickers just to be pests and cause trouble. (This is individually marked/stickered items and not items with price labels on the shelf, that is different again)

When I was in bi-lo .. now known as 'coles' ... there was a $5 bag of lollies, was $5 at shelf.. but scanned at $4.xxc, I got it for free!! yeahhh! [[true story]]

I work at Franklins and if something scans at a higher price than ticketed, the customer gets it for free.

Speaking of supermarkets, but a bit off topic, I bought some shredded pizza cheese tonight from Woolies, and the use by date was July 2007. I opened it when I got home, put it on my food, only to discover heaps of green shreds of cheese! Look in the rest of the packet and its all through them...

They arent turning the fridges up/down to the right temp during the hotter weather - was very hot here today. Or perhaps the refrigerated transport vehicles that bring it to the supermarket could be faulty as well....

Still, it makes me wonder about food poisoning, storage temps at supermarkets and certain foods which are very sensitive to storage temps ie cheese, dairy, prepared meats etc... my son got food poisoning from Smiley Fritz from a Coles once - it was tested!

Use by dates dont mean much if food is not stored properly.

Sorry, end of rant... LOL.

That is how it works at Safeway.

If you purchase an item and it scans higher than the ticketed price, you get it for free.

If you buy several, you get one free unit, and the rest will be charged at the proper price.

If the shelf price is higher than the price you are charged, you don't get it for free. You are saving money, so stop whinging! Take it and run!

Sounds fair to me.

Bit like the IKEA ad where the chic runs off getting her husband to start the car because she thinks she got it too cheap...hehe.

I remember when my sister first moved into her house, she needed a tv arial, wnet out and bought one from kmart or something, and there was an error on the machine, and it was coming up that the price was 3c. She only had to pay the 5c. Not bad eh.

All the examples of getting it for free are nice, but not the law. One of the links I provided previously outlined the scanning code of practice which most of the supermarkets are signatories to.
If it is not
* Bi-Lo Supermarkets
* Coles Supermarkets
* Franklins
* Woolworths Supermarkets
they are not obliged to give it to your for free (if it scans higher) or even the price it scans(if it scans lower) or for the price on an individual ticket in certain circumstances. Sure most places like Kmart and Big W etc give it to you for the price it scanned at/is ticketed at, as a sign of goodwill, but they do not have to.

At work today, a drill scanned up for $88 something, was down as $29 on the shelf, we gave it to the customer for the lower price, for as long as i have worked there it has always happened like that.

I worked as a Customer Service Supervisor at a BiLo for 5 years, the supermarket, "Scans high and you get it free" is company policy basically, it's not the law, as stated above, it applies to scanning code of practice, basically if they decide to stop doing it, there's nothing that can be done.

In saying that though, it is law that an item needs to be sold for the advertised price, until the item is completely recalled by the company (ie, no store in the state can sell it for any price) once it has been recalled, an ad must be placed in all major newspapers with an apology and reason for the more expensive price.

If it's a ticket (the price tag on the shelf) that's incorrect, more often than not, the offending ticket will just be removed from the shelf and a new one printed when they get around to it.
