Default about to cry!!

last night at about 7pm i had a man rock up to my doorstep and told my mum she had 2 give him the 2002 white BA falcon its being repossessed! i wasn't home i was at mates i get this phone call from my brother saying my car is going to be repossessed come home. so when i got home the debt collector explained to me the guy who owned the car before me had finance on the car and hasn't paid so he has to repossess the car. im like wait a minute this isn't his car its mine. and because i got it so cheap 8400 i thought something wasn't right so i got a thing that he signed saying there is no finance on the car or anything like that. we called the police and they said its going to be about a 2 year process to get my money back from him. what can i do? is there an easier way oh yeah im an apprentice who relies on a car to work. and i don't make enough to buy another one and to top it all off i got a 7 grand loan for that car a personal loan so they couldn't take the car off me. so my situation is i have no car, 7 grand loan and possibly no job if i don't get a car soon. my parents will probably buy me a car of similar value etc. and then they get the money when we go through the courts.

end rant.

yeah i went changed over the rego checked it wasnt stolen. i have now found out that there is a hotline you can call to see if there is finance on a car. i didnt know that when i brought it

Hard luck bud, it might be worth you checking with the other guy (or his financier) to see what can be worked out. It might be being repo'd for only a fraction of what it would cost you to buy another one. Get on the phone, maybe you can take over his finance if it is economical to do so??

you did ask they guy for ID and have all the documentation of it being repoed dont you?
as mentioned, REVS are there to check this sort of thing so this doesnt happen.
to get the car back (if you can work out an agreement with the financier) you (or he - wont happen) has to pay what is owed. the car will only be repoed if 3 consecutive payments are missed, so youll be up for at least 3 months of payments which could be $100 or $1500.
you better ring your financier as well and tell them what has happened, you may be able to work something out with them to help you with your loan.
as always though, if it seems too good to be true- it probably is.

people laugh at me when i tell them they MUST do a revs check!

Any of my mates who are buying a car I do one for them, even tho it costs me a few dollars ($21 to be exact) id rather not see this kind of thing happen (as im in the finance industry).

You need to talk to the finance company who repossessed it, im not real sure what avenue you have of getting your money back off the who sold it to you, but its unlikely you'll see a cent!

i was gonna wrap the ba$tard round a tree on the way home but had someone else in the car at the time and she was sketching out. my mum is ringing the financier today, and yes i did ask the debt collector for id and paperwork. it sucks because i cant go after him and get it all myself because ill get put in jail. and i know i will get what i want if i send people around. but ive been told by police if anything happens to him he gets off scott free and ill get raped instead. so i have to wait. im so mad because there is nothing i can do.

So you just let them take the car?

As far as i know it is illegal for a repo co. to come on to private property and take the car without a court order.
You should have told them to get a court hearing and summonds you at which point you could put your case across to a neutral party.

You obviously paid for the car with your money and have rego and a reciept for it so it's as much yours as it is anyone elses.
What was he going to do, beat you up, i think not coz then the cops would be interested.

People fall for this all the time coz the guy is big, why do you think they employ intimidating people?
Coz they know your less likely to argue, but they still cant touch you.

I would have done that to be a bastard, costs on them for that anyway.

Thats a crappy situation mate, while you should always check I know I have never done it so I cant comment.

There must be something that you can do, as above, talk to the finance company pronto.

something like this happened to a mates old man, he paid cash for some items and then they were never delivered and the seller refused to hand over the goods after a polite phone call.

It was resolved by 4 or so rather large fellows paying the guy a visit one night to help his memory along with regards to delivery of said items. LOL

Sux about the car thou man, You need to look at all your options.

The RAC have a legal department for this sort of thing. If your not a member might be worth finding a freind who is. Otherwise might just be worth a call to them anyway to see if they can do anything on your behalf. You may have to join, but its not that costly. Hope if gets sorted. This sort of thing sucks.
Had a company that owed us $5000 go bankrupt never got a cent off them :(

I have just read the old contract for my BA which was through Ford credit.
It says that they are not allowed to come onto private property without permission from the owner or a court order.
Sec 21 of their contract notes states 'the creditor cannot remove the vehicle from a residential premises without either a court order or written permission from the owner/occupier'
Sec 24 states' a creditor may not harass or threaten a client for oustanding money or goods'
My brother inlaw had a car through Esanda finance which he defaulted on.
They sent out a repo guy who said he was there to take posession of the car, the brother in law said the car wasn't going anywhere and the repo guy left.
he got a summonds in the mail a few weeks later and when he went to court the judge said he could pay them $40 a fortnight and keep the car.

the financial joint is as useful as tits on a bull. they said if he pays it in the next 21 days i can have my car back but they will give it back to him. the police are charging him with deception because we got the thing signed by him saying that there was no finance and also his toyota surf that he has is not registered in his name so they are taking the plates so he cant drive it....he will get locked up until his bail is paid then he has to go to court. thats what the police said today!
