Default Accident in uninsured car

Hi Guys,

I ran up the back of a vw Tiguan in an ininsured car (not my car but I was driving and I admitted it was my fault which it was). The persons insurance company contacted me and said they would use their preferred repair shop. I am new to this but I always thought they had to get 3 quotes or I could choose the repair company. Does anyone have any experience with this or know what I should do now? It was just a small bump. I think I cracked the bumper in one spot? Knocked some paint off and broke a couple of reversing sensors. The car I was in has just the slightest dent in the bonnet. I should have lin d it up to make sure my car did all the damage. It probably did but the person I hit seemed rather dodgy.

In future don't drive uninsured on the road, next time you might hit a Bentley.

Sorry mate, unless you have a sold case and a legal firm, it will be up to to you to sort it out. It sucks hard because the chances are the other driver will try and ping every other mark on the car in you. I have been there before, but on my side the offending driver was In reverse, therefore at fault

It also absolutely sucks for the other driver. Having to organise an assessment, losing the car for a week, missing work to drop off and pick up the car.

Yeah thanks guys. Was my fault so I'm happy to pay. Just want to make sure it is all fair. like I say I got a real dodgy vibe from them to say the least. Crap I honestly e it's not $4k!

I ran up the back of a VE wagon in similar fashion. My car was insured, but the damage bill was under $500 so i just paid it. I had another accident earlier when i wasnt insured, side damage through a dual turning lane. The insurance company for the other party initially called me up before issuing anything, i emailed back statements, quotes, pictures of the car and a few diagrams to try prove negligence on the other driver and it basically ended at he said/she said with neither party having proof of fault according to them.

They said they use their preferred provider. Could hardly understand her but it sounded like they just take it to their place and get it fixed then send me a letter of demand. Would feel better if they got 3 quotes.

I cannot see any rule about three quotes. I would certainly want it itemised though.

I suppose you could always ask the owner to get another quote to put you at ease, but that would be a big ask I suspect if they just want their insurance to handle it

I ran up the back of a van years ago and decided to do it out of my insurance as it would have cost me more in the long run. I had him take his van to my chosen repairer (a mate of mine) and had it fixed there. His insurance company tried to use their repairer but in the end I won as it was my choice not his on where I had it repaired.

With their insurance company involved the insurance company are paying for the repair. They will then pursue the person at fault to repay them.
I doubt you have much option or right.

They don't care what you think or want,her insurance will chase you for the money once they work out how much they want from you.
Ive been there twice already,your insurance will get more expensive too once they find out.
Court is not fun,try not to let it go that far,the judge will make you feel/look stupid lol

You have no right to say where it goes or option to get 3 quotes.
Your at fault you wear it.
Remember most panels shops charge $150+ for a quote now refindable when they get the work.
You drove an uninsured car , bend over and get ready for it to hurt.

Can insist and ask all he wants, they will do whatever they want.

Uninsured at fault third party has virtually no rights.


Look at it this way, your driving along all insured, and someone rear ends you that isn't insured.
They say they want it repaired by their choice of repairer, but you have full comp insurance which also include choice of repairer.... Are you going to forgo your choice of repairer so the at fault uninsured party can send it to his mate down the road that will do a quick bodgy for a third of the cost?

Big difference between at fault and not fault. I'm going through currently with my panelvan. Even though I wasn't insured, I also wasn't at fault and I was given three options by nrma,
-go with their choice of repairer
-go with my choice of repairer, get 2/3 quotes and get one approved
-take a cash settlement

I went with the first option, and got given a choice of about half a dozen repairers in my area, van goes in on Monday, and they're also paying for a rental car for me until the van is ready.

I dont see why the person at fault should be telling the person they hit where they would get their car repaired (as long as the price is reasonable). If it was the other way around would someone be happy to be told where they get their car repaired? Personally if it was my car I would be going to whom I like to get it repaired. If the person at fault would be happy to get it done cheaper through the same person then I have no problem. Otherwise thats why I pay full insureance with the company I'm with.

Unfortunetley the person at fault had an uninsured car and will learn an expensive lesson.

the insurance company only need to get one quote.

It's the same if someone hits your car, you only need to provide 1 quote and it can be from any repairer you choose.

As long as it fair and reasonable cost.

If your not at fault never let the other persons insurance company tell you where to get your car repaired as they have no right to. Remember you don't have a contract with them and if the other person lodges a claim and the repairer of your choice is fair and reasonable they need to accept the quote.

Cross your fingers you're not going to end up like the uninsured fellow that ran into the back of my AMG last year.

Apart from the over the top cost of replacing and spraying a rear bar which only had minor marks he got to pay for the paint blending on a Mercedes and as it took over a week to complete the job due to rain he received an extra invoice of close to $3,000 for the hire car that was provided to lessen my inconvenience.

You want to hope they didn't feel the need to pay for top end same for same coverage like I did.

Why why why

Their insurance can basically do whatever they want as the insurance will have to redeem the costs which means more then likely wages be garnished to pay off the debt you will have to pay off.

Theres really nothing you can do other then asking for invoices and itemized costings im sure.

Prepare to be reamed and deservingly so.

the insurer will go to one repairer of their choice and have the vehicle assessed and repaired. Don't be surprised if the owner gets a hire car during this period. You will be paying for that too.

Legal aid isn't going to help you "get out' of anything because all the costs will be by the book and justified.

Maybe you could start looking at saving.

You can "ask" them sure, they will say no.

Some guy smashed into YOUR car and you will let them dictate to you who will repair it, their repairer might be a few hours from were you live and that'll be OK with you because THEY are paying.

Anyway in the case of the OP the insurance company is paying and therefore choosing the repairer, or letting the owner choose the repairer. Then they send a big bill to the OP.

End of story, nothing more for the OP to do until he gets the bill.

Say your premium was $800 and you have gone 10 years
without a claim ,saving $8000, this claim say $7000,
your in front.

Unfortunately (fortunately for those that have insurance) it is not so, it's up to the owner of the damaged car where they want to take it.

They did nothing wrong and everything right why should they be put out and possibly have sub standard repairs done to their car??

I remember some uninsured bloke running up the back of my freshly and professionally painted (reputable panel shop) GT Cortina years ago while I was stopped at a set of lights, the paint had hardly dried, and he wanted me to take the car to his mate who repaired cars in his back yard to get the repairs done I had full insurance so guess where my car went?? Not the blokes mates back yard thats for sure, insurance company ended up taking the uninsured driver to Court.

I ended up taking a cash pay out for damage and organising my own repairs.

Not likely unless you an prove hardship in some way.

Easier to have car insured IMO, even if you don't care about your own car, third party property damage does not cost a lot, and I would never leave home without it.

In my personal opinion if you can't afford insurance you can't afford to drive, stick to catching a bus.
