Soldier 3 because if he doesn't hear anything, he knows that soldier 4 can see 2 different coloured hats, thus he knows that soldier 2's hat is white, his must be black. If Soldier 4 could see two of the same colour in front of him, he's speak straight away.

Took me a few minutes though! It's late, I need sleep.

soldier 2 can't see anything, he's out too.

Soldier 3 can only see a white hat, he can't tell anything for certain.

Soldier 4 can see one of each, he can take a 50% chance but this isn't a chance thing, it has to be definite.

Basically, IF Soldier 4 COULD see two black hats or two white hats on the 2 soldier in front of him, he'd straight away know he had the opposite and he'd call out with 100% confidence. If the two in front of him have different hats, he can't be certain so he won't say anything.

In this case, soldier 3 knows that if soldier 4 doesn't say anything, then soldiers 2 and three can't have the same hat on, thus he must have the opposite of solier 2.

Get it?
