Soldier 3 because if he doesn't hear anything, he knows that soldier 4 can see 2 different coloured hats, thus he knows that soldier 2's hat is white, his must be black. If Soldier 4 could see two of the same colour in front of him, he's speak straight away.
Took me a few minutes though! It's late, I need sleep.

In this case, soldier 3 knows that if soldier 4 doesn't say anything, then soldiers 2 and three can't have the same hat on, thus he must have the opposite of solier 2. Get it?
