Hey Guys,
I'm contesting a ticket for driving in a T3 (transit) lane in Brisbane QLD, just wondering if anyone knew the laws on exactly how far you can drive in the lane. Basically the T3 lane was in the left lane and to turn left off the street you obviously have to travel in the lane for a while, I pulled on to the street and drove in the T3 lane for 250m before they pulled me over, if I hadn't of been stopped I only would have been in the lane for 375m. As far as I know you are allowed 400m to merge into the correct lane or take your turn before breaking the law, am I correct? Also are there any laws regarding the distance from a change of speed zone that the cops can set up a radar? Thanks Heaps Brenden |

Okay, according to QLD rules - from what I can tell its only 100m. Sorry mate.
Check it out yourself. http://www.legislation.qld.gov.au/LE...ntOpRURR99.pdf Checkout page 147, section 158. "(4) In this section— permitted distance means— (a) for a bicycle lane—50m; or (b) for any other lane—100m."

What a stupid law. Your just a victim of stupidity. Pay the fine and then write a proper letter to your MP telling him/her of how you paid the fine but resent being a victim of a law that clearly could put a persons life in danger. Dont rant in the letter. Yell into a garbage can to make you feel better.

Just dont pay it and make them work for it.
Worst case scenario a sheriff will come around to talk to you about it. After about 12 months! The time in between there where they would have had peopole punching away at computers and actual manpower in trying to locate you will have cost them alot more than $100 and then karma will be restored. Go on a payment plan and pay like $5.00 p/week so that you barely notice the financial hit. Plus its extra expenses for them to set up a payment plan. |

I nearly got done for it on Victoria rd at Drummoyne.
I needed to turn left into a side street ... i changed into the T3 lane (which was dead empty) .... as the other lanes were at a standstill as they are of a morning along there. Cop was hiding in the side street ... and pulled me over as I turned into the street. I had a discussion about it ... he told me the exactly ruling (100m as I found out that morning). As a joke I said I had 8 people on-board ... he gave me a puzzled look. I pulled the tonneau up and showed him the cases of St John resus maniquins in the back. He laughed at that and said "That's a good one ... I'll let you go for that." I fell over in shock nearly ... wished him a nice day and went on my way. In NSW it's a 3-point fine as well ... thank god i didn't get done for it.

My dad got off for the exact same thing by sending them a friendly letter explaining the situation, they sent back saying if youve been a good boy over the last ten years, we'll see what we can do. So he had to send them a record of his driving history.
A little while later he got a letter back pretty much saying 'your lucky this time, we'll let you off, but dont do it again'.

Thats really smart, your just asking them to lodge a default against you under payment arangement which will effect your credit file for the next 5 years, along with additional interest and court costs for processing. And it does go on because baycorp/creditadvantage receive court transcript information. great advise, not. |

I agree with JG66ME on this one. Just pay the fine, and write a calm, calculated letter to your local MP. Explain your reasoning as to why you believe it is unsafe to be able to only travel in a T3 lane for 100m at highway speeds when you are having to then stop and turn. Democracy has to work somehow, I doubt it will work, but I would cop it on the chin.
